RULING
This matter came before the Tribunal pursuant to a referral from Labour Relations Officer, Mr. Lauren Smith.
The Claimant states that he was not remunerated for wages in the amount of $75,000 for the year 2022, $37,500 for the year 2023, and commission in the amount of $24,000 for the year 2023.
The Tribunal made an Order for directions on February 23, 2024. The Order required, among other things, that the Claimant submit a written Statement of Claim and the Respondent, Mr. as joint receiver of Ltd ( , submit a Defense (or Response).
The Tribunal is satisfied that it can dispose of this matter based on the statements of case submitted.
The Tribunal finds that Mr. not (and has never been) the Claimant’s employer.
6. To the extent the Claimant has a valid claim for unpaid wages and commission he must pursue that claim against The Tribunal does not have the power to add ! as a party to this matter.
