7 Commencement
The Collector of Customs, reviewing the powers conferred upon her by section 5B of the Revenue Act 1898 to prescribe the contents and delivery of advance cargo manifests, gives notice as follows:—
Citation
1 This Notice may be cited as the Advance Delivery of Inward Cargo Manifests Notice 2007.
Interpretation
2 In this Notice—
“the Act” means the Revenue Act 1898;
“the manifest” means the manifests referred to in section 5A of the Act;
“aircraft” includes every description of aeroplane or other aircraft;
“commercial purpose” includes the carriage of persons or goods for any fare, fee, rate, charge or other consideration, or directly or indirectly in connection with any business, or other undertaking intended for profit; and
“ship” includes every description of ship or vessel.
Application of this Notice to certain categories of ships and aircraft
3 Section 5A(1) of the Act and this Notice shall apply in respect of—

a) every ship departing for Bermuda for a commercial purpose; and
b) every aircraft departing for Bermuda.
4. Electronic means of delivery of manifest
(1) The master of a ship shall deliver the manifest by e-mail to e-mail address customsmanifest@gov.bm .
(2) The commander or the agent or representative of an aircraft shall deliver the manifest by e-mail to e-mail address customsmanifest@gov.bm .
5. Time of delivery of manifest
(1) The master of a ship shall—
a) where the voyage is intended to exceed ninety-six hours in duration, deliver the manifest not later than ninety-six hours prior to the arrival of the ship in Bermuda; and
b) where the voyage is intended not to exceed ninety-six hours in duration, deliver the manifest not later than the time of departure of the ship for Bermuda.
(2) The commander or the agent or representative of an aircraft shall deliver the manifest not later than the time of departure of the aircraft for Bermuda:
Provided that the commander or the agent or representative of any air ambulance in service of a medical emergency may, instead of complying with subparagraph (2), deliver the manifest not later than thirty minutes after the time of departure of the air ambulance for Bermuda.
6. Additional information to be included in manifest
(1) The master of every vessel departing for Bermuda shall include the following additional information in the manifest—
a) name of and nationality of the ship;
b) name of the shipping line or operator;
c) voyage number;
d) port arrived from;
e) port of destination;
f) port and date of arrival of the ship;
g) nature and particulars of any dangerous cargo; and
h) in respect of every item, package and parcel of goods on board the ship—
i) shipper;
ii) bill of lading number; and
iii) where applicable, the container identification.

(2) The master shall also include in the manifest the following declaration in respect of the manifest: “ I [blank] declare to the best of my knowledge, that this cargo manifest, consisting of [blank] page(s) contains a true and proper account of every item, package and parcel of goods on board the vessel [blank] intended to be landed in Bermuda. Signed [blank] Dated [blank]”
(2) The commander or the agent or representative of an aircraft departing for Bermuda shall include the following additional information in the manifest—
a) the registration number of the aircraft;
b) the name of the airline or operator;
c) flight number;
d) airport arrived from;
e) airport of destination;
f) date of arrival of the aircraft
g) nature and particulars of any dangerous cargo; and
h) in respect of every item, package and parcel of goods on board the aircraft—
i) shipper;
ii) air waybill number;

7 This Notice shall have effect from the 1st day of April 2007.
