OBSCENE PUBLICATIONS (CLASSIFICATION AND RESTRICTIONS AS TO SALE) REGULATIONS 1981 [made under section 10(2) of the Obscene Publications Act 1973 [title 10 item 12] and brought into operation on 18 December 1981]

SCHEDULE

Citation

1 These Regulations may be cited as the Obscene Publications (Classification and Restrictions as to Sale) Regulations 1981.

Salacious magazines

2 The magazines specified in the Schedule are classified as magazines containing salacious material.

3. Restrictions

(1) No person shall sell or offer for sale to the public any magazine classified under regulation 2 as containing salacious material and specified in the Schedule unless it is displayed for sale—

(a) not less than six feet from the floor of the premises;

(b) in such a manner that only the title of the magazine may be read;

(c) in such a manner so as to prevent potential customers from looking or leafing through the magazine.

(2) Any person who contravenes paragraph (1) of this regulation commits an offence: Punishment on summary conviction: imprisonment for 3 months or a fine of $250 or both such imprisonment and fine.
