PARKING OF VEHICLES (DESIGNATED AREAS) ACT 1973

ARRANGEMENT OF SECTIONS

Interpretation

1 In this Act— "appropriate authority" means an authority declared to be the appropriate authority in respect of a designated area; "designated area" means an area declared to be a designated area under section 2; "the Minister" means the Minister charged with responsibility for Works and Engineering.

2. Minister may make orders

(1) For the purposes of this Act the Minister may by order published in the Gazette—

(a) declare any area of land vested in the Government to be a designated area; and

(b) declare any authority to be the appropriate authority in respect of a designated area.

(2) Section 6 of the Statutory Instruments Act 1977 [title 1 item 3] shall not apply to an order made under this section.

3. Notices in designated areas

(1) The Minister shall cause notices to be erected prohibiting, restricting or regulating the parking of vehicles within a designated area.

(2) Any person who removes, defaces, damages or obscures or otherwise interferes with a notice lawfully erected under the authority of subsection (1) commits an offence: Punishment on summary conviction: a fine of $50.

(3) For the purposes of this section a notice erected within a designated area shall be deemed to have been lawfully so erected unless the contrary is proved.

Illegal parking

4 Any person who parks a vehicle within a designated area in contravention of a notice erected under section 3 commits an offence against this Act.

5. Reserved areas

(1) The appropriate authority may reserve the whole or a portion of a designated area for official use.

(2) Any person who parks a vehicle within an area reserved under subsection (1) without the permission of the appropriate authority, proof of which shall be upon him, commits an offence against this Act.

(3) The appropriate authority may issue permits for the purposes of this section.

Punishment for offences

6 Where a person commits an offence under this Act: Punishment on summary conviction: the penalty specified in Schedule 1 to the Traffic Offences (Penalties) Act 1976 [title 21 item 13].
