PROCLAMATION ESTABLISHING AN EXCLUSIVE ECONOMIC ZONE FOR BERMUDA

IN THE NAME OF HER MAJESTY ELIZABETH II, by the Grace of God of the United Kingdom of Great Britain and Northern Ireland and of Her other Realms and Territories Queen, Head of the Commonwealth, Defender of the Faith, BY THE RIGHT HONOURABLE LORD WADDINGTON, Governor and Commander-in-Chief of Bermuda, WHEREAS there is a need to establish and to regulate activity in an exclusive economic zone around Bermuda in accordance with the rules of international law, NOW THEREFORE I, DAVID CHARLES, BARON WADDINGTON OF READ, acting in pursuance of instructions given by Her Majesty through a Secretary of State, do HEREBY PROCLAIM as follows:
1 There is established for Bermuda an exclusive economic zone having as its inner boundaries the outer limits of the territorial sea of Bermuda and as its seaward boundary a line drawn so that each point on the line is 200 nautical miles from the nearest point on the baselines defined in the Bermuda (Territorial Sea) Order in Council 1988.
2 Any rights exercisable over the waters of the exclusive economic zone and its seabed and subsoil, as well as the natural resources thereof (whether living or non-living), are hereby vested in Her Majesty.
3 In regard to the exclusive economic zone, Her Majesty will exercise jurisdiction in accordance with the rules of international law over the exploration and exploitation and the conservation and management of the natural resources (whether living or non-living), over the protection and preservation of the marine environment, over marine scientific research

and over other activities for the economic exploitation and exploration of the zone, subject to such provision as is in force or may hereafter be made by law for such matters.
4 This Proclamation shall come into operation on the date on which the Fisheries Amendment Act 1996 comes into operation and on that date the Proclamations made by the Governor and respectively published in the Gazette on the 11th day of March 1972 and the 20th day of May 1977 proclaiming an exclusive fishing zone for Bermuda shall cease to have effect.

[Upon the coming into operation of this Proclamation, the Proclamation Establishing a Fisheries Zone Contiguous to the Territorial Sea of Bermuda and the Proclamation Extending the Limits of the Fisheries Zone of Bermuda ceased to have effect.]
