1 Changes in amounts of customs duties to have statutory force

1. Changes in amounts of customs duties to have statutory force
(1) Subject to subsection (2), where a report is presented by the Minister of Finance, or a Bill is read a first time in the House of Assembly, which recommends, or provides for, a variation of any duty payable under the Customs Tariff Act in force for the time being and, in the case of a report, such report contains a declaration that it is expedient in the public interest that the recommendations contained therein shall have statutory effect under this Act, then the variation of such duty recommended in such report, or provided for in such Bill, shall for the period of four months have statutory effect as if it were contained in an Act amending the Customs Tariff Act for the time being in force and shall, during such period, and subject to this Act, have full force and effect as if it were a provision of law.
(2) A recommendation of a provision referred to in subsection
(1) shall cease to have statutory effect if it is not agreed to by the House of Assembly, or passed by the Legislature, before the expiration of the session of the Legislature during which it is presented, or introduced, and in any such case any additional duties which have been paid, in consequence of subsection (1), shall be deemed to be duty paid in excess and shall, upon application to the Collector of Customs, be refunded to the payer thereon.
