PUBLIC HEALTH (COVID-19 EMERGENCY POWERS) (NO. 2) REGULATIONS 2022 (SAVINGS PROVISIONS) REGULATIONS 2022

Her Excellency the Governor, on the advice of the Minister responsible for health, in exercise of the power conferred by section 107B of the Public Health Act 1949, makes the following Regulations:

Citation

1 These Regulations may be cited as the Public Health (COVID-19 Emergency Powers)(No. 2) Regulations 2022 (Savings Provisions) Regulations 2022.

2. Savings under Public Health (COVID-19 Emergency Powers) (No. 2) Regulations 2022

(1) Pursuant to section 107B(6) of the Public Health Act 1949 and by virtue of the Public Health (COVID-19) Emergency Order 2022 ceasing to be in force as of 30 November 2022, the Public Health (COVID-19 Emergency Powers)(No. 2) Regulations

2022 (“the Regulations”) accordingly cease to be in force as of 30 November 2022.

(2) Notwithstanding that the Regulations shall cease to be in force as provided under paragraph (1), the following shall continue to be in force—

(a) a public health penalty ticket issued before the Regulations ceased to be in force; and

(b) the period within which the payment of the applicable public health penalty ticket, referred to in subparagraph (a), is to be made.

(3) For the avoidance of doubt, the ceasing of the Regulations to be in force shall not affect the prosecution of a person for an offence under the Regulations which was committed before the commencement of these Regulations.
