PUBLIC HEALTH (COVID-19) PENALTIES REGULATIONS 2021 REVOCATION REGULATIONS 2022

The Minister responsible for health, in exercise of the power conferred by section

107K of the Public Health Act 1949, makes the following Regulations:

Citation

1 These Regulations may be cited as the Public Health (COVID-19) Penalties Regulations 2021 Revocation Regulations 2022.

2. Revocation of Public Health (COVID-19) Penalties Regulations 2021

(1) The Public Health (COVID-19) Penalties Regulations 2021 are hereby revoked (the “revoked Regulations”).

(2) Notwithstanding the revocation under paragraph (1), the following shall continue to have effect—

(a) a public health penalty ticket issued before the revocation; and

(b) the period of payment of the applicable public health penalty ticket referred to in subparagraph (a).

(3) All actions, investigations or legal proceedings commenced with respect to a public health penalty ticket issued under the revoked Regulations by the Minister of Health may be carried out or prosecuted by or against the Ministry of Health, and no such action, investigation or legal proceedings shall abate or be affected by the coming into operation of these Regulations.

(4) For the avoidance of doubt, the revocation under paragraph (1) shall not affect the prosecution of a person for an offence under the revoked Regulations which was committed before the commencement of these Regulations.
