AMERICA’S CUP CONCESSION (BEN AINSLIE RACING) ORDER 2016
BR 105 / 2016
WHEREAS the Team Manager of the British America’s Cup Challenger Ben Ainslie Racing has by written application dated 5 July 2016 applied for an America’s Cup concession order under section 14 of the America’s Cup Act 2015; AND WHEREAS the Minister responsible for the America’s Cup has determined, in accordance with section 15 of the America’s Cup Act 2015, that granting the application is necessary for the proper conduct and operation of the Bermuda Events and in the best interests of Bermuda; The Minister responsible for the America’s Cup, in exercise of the power conferred by section 15 of the America’s Cup Act 2015, makes the following Order:
Citation
1 This Order may be cited as the America’s Cup Concession (Ben Ainslie Racing) Order 2016.
Interpretation
2 In this Order, “Ben Ainslie Racing” means Ben Ainslie Racing (Bermuda) Ltd, a company incorporated in Bermuda on 4 May 2016 and licensed to carry on business in connection with its acting as a competitor in the 35th America’s Cup.
Exemptions under section 8 of the Act
3 Section 8 of the America’s Cup Act 2015 (employment) shall apply to Ben Ainslie Racing as it applies to ACEA.

4. Exemptions relating to motor vehicles
(1) Ben Ainslie Racing and its designated commercial partners may, without paying any licence duty or fee which would otherwise be payable under the Motor Car Act 1951, import and license for use on public roads during the event period—
(a) a maximum of six motor vehicles (in total) not exceeding 197 inches by 82 inches, for use as private motor cars; and
(b) a maximum of six motor vehicles (in total) not exceeding 196 inches by 82 inches, for use as passenger motor cars.
(2) Paragraph (1) is subject to the following conditions—
(a) the motor vehicles shall only be used to transport personnel involved in the Bermuda Events and their representatives;
(b) no person shall be charged a fee in respect of the use of the vehicles;
(c) the motor vehicles shall be removed from Bermuda no later than the end of the event period; and
(d) motor vehicles falling within paragraph (1)(b) shall only be driven by a person falling within the definition of Bermudian labour who has a valid Bermuda driver’s licence for a public service vehicle.
