REGULATORY AUTHORITY (AMALGAMATION OF NORTH ROCK COMMUNICATIONS LTD. AND LOGIC COMMUNICATIONS LTD.) REVOCATION

The Regulatory Authority, in exercise of the power conferred by sections 63 and

66 of the Regulatory Authority Act 2011, makes the following Emergency General Determination and Order:

Citation

1 This Emergency General Determination and Order may be cited as the Regulatory Authority (Amalgamation of North Rock Communications Ltd. and Logic Communications Ltd.) Revocation Emergency General Determination and Order 2013.

Interpretation

2 In this Emergency General Determination and Order, unless the context otherwise requires, all relevant terms shall have the meaning given in the Regulatory Authority Act

2011 and the Electronic Communications Act 2011.

Revocation

3 The Regulatory Authority (Amalgamation of North Rock Communications Ltd. and Logic Communications Ltd.) Emergency General Determination and Order 2013 is revoked.

Terms and conditions

4 The Schedule has effect.

Revocation of Emergency General Determination and Order Matter: E13/05 – 892

REGULATORY AUTHORITY (AMALGAMATION OF NORTH ROCK COMMUNICATIONS LTD. AND LOGIC COMMUNICATIONS LTD.) REVOCATION

The Regulatory Authority, in its exercise of the power conferred by sections 63 and 66 (2) of the Regulatory Act 2011, hereby revokes the Emergency General Determination Matter E13/04-856 dated 29th April with immediate effect.

The Emergency General Determination Matter E13/04-856 is being revoked in light of new competitive developments in the residential Internet Service Provider market and after the RA having had sufficient time to examine the licensing issues.

The RA will issue an ICOL to Logic. The ICOL will include the relevant assignment of spectrum used by North Rock Communications Ltd except that the 902 MHZ to 928 MHZ that North Rock Communications had not deployed is being withdrawn.

Logic has withdrawn the request for spectrum made by North Rock Communications Ltd on March 4, 2013.
