The Regulatory Authority, in exercise of the power conferred by section 66 of the Regulatory Authority Act 2011 and section 46 of the Electronic Communications Act 2011, makes the following Interim General Determination:

Citation

1 This Interim General Determination may be cited as the Regulatory Authority (National Numbering Plan) Interim General Determination 2014.

Interpretation

2 In this Interim General Determination unless the context otherwise requires all relevant terms shall have the meaning given in the Regulatory Authority Act 2011 and the Electronic Communications Act 2011.

General Purpose

3 This Interim General Determination prescribes the current number block assignments granted to each Integrated Communications Operators Licence holder. It has been made on an interim basis pursuant to section 66(1) of the Regulatory Authority Act

2011 pending the completion of a consultation on this issue.

Terms and conditions of the Interim General Determination

4 The Schedule has effect.

The Regulatory Authority (‘the RA’) hereby issues this Interim General Determination pursuant to section 66 of the Regulatory Authority Act

2011 (‘the RAA’).

1. Statement Explaining Basis for Interim Determination

Determination, the Number Portability General Determination will also go into legal effect requiring voice communications providers to allow customers to retain their existing telephone numbers if they choose to switch to another provider. The plan through which mobile and fixed telephone numbers have been provided to voice communications providers has never been the subject of public scrutiny or published on a national level. Historically, communications providers would apply to the Department of Telecommunications and request that a particular block of numbers is assigned to it for distribution to its customers. If there were no good reasons to prevent those numbers from being used, the Department would grant the request and those numbers would be activated for use in Bermuda. To the knowledge of the RA there have been no major issues with the manner in which number assignment has been previously administered. The only issue is that it has not been made public.

2. Section 47(1) of the (‘the ECA’), however, provides as follows:

“The [RA] shall make a general determination to facilitate subscribers to retain a fixed or mobile telephone number assigned to them by their existing communications provider under the numbering plan pursuant to section 46, when such subscribers elect to switch to another communications provider.”

Section 46(1) of the ECA provides as follows: “The [RA] shall adopt, by general determination, and publish a national numbering plan for those categories of communications providers that it deems eligible for participation in the national numbering scheme”

3. As a result of these two provisions of the ECA the RA has

decided it would be prudent to ensure that, by way of General Determination, it formally adopts the numbering plan currently being used by all communications providers. This will ensure that there is clarity amongst consumers and communications providers regarding which numbers consumers will be entitled to retain when switching providers upon the implementation of number portability in March 2014.

4. The first date by which carriers will be required to implement

number portability is about 2 months away. However, the RA is concerned that waiting until after the consultation process on the implementation of a number plan is completed before publishing the national number plan would make it difficult to ensure that the numbering plan is in place and clearly articulated ahead of the implementation of Number Portability. It is very likely that the consultation process will not run much further past the implementation date for Number Portability (if at all) but to avoid that possibility, the RA has decided to issue an Interim General Determination concerning the National Numbering Plan.

5. Interim General Determination

the RAA 2011, the RA hereby determines, on an interim basis, to adopt the National Numbering Plan set out at Annex 1 to this Interim General Determination.

6. This Interim General Determination shall become effective on

the date on which it is published in the Gazette.
