ROAD TRAFFIC (WESTERN SECTION OF THE RAILWAY PATH) ORDER 1955

[made under section 4 of the Road Traffic Act 1947 [title 21 item 3] and brought into operation on 20 January 1955]

1 This Order may be cited as the Road Traffic (Western Section of the Railway Path) Order 1954.

Interpretation

2 For the purpose of this Order "the Western section of the railway path" means those parts of the railway path lying between Franks Bay in Southampton Parish and the former railway terminal at Somerset in Sandys Parish which have been declared to constitute highways.

3. Restrictions on type of vehicle

(1) Subject to article 4

(a) no vehicle other than a pedal bicycle, a tricycle or other vehicle which is not motor propelled shall be used or driven on those parts of the railway path lying between Franks Bay in Southampton Parish and George's Bay Road in Southampton Parish which have been declared to constitute highways; or

(b) no vehicle other than a cycle, an auxiliary bicycle or a horse drawn vehicle shall be used or driven on those parts of the railway path beginning at George's Bay Road in Southampton Parish and ending at the former railway terminal at Somerset in Sandys Parish which have been declared to constitute highways: Provided that nothing in the foregoing provisions of this paragraph shall have effect so as to prohibit the use or driving of any motor car on the Western section of the railway path in any of the following circumstances, that is to say—

(i) an emergency vehicle, whilst being used or driven in connection with an emergency arising on, or in a place adjacent to, the railway path; or

(ii) a motor car, whilst being used or driven under the authority of the Minister of Transport, the Minister of Works and Engineering and the Minister of Health and Social Services, in connection with the inspection, repair, maintenance, cleansing or scavenging of the railway path or of any land adjacent thereto,

(2) Nothing in paragraph (1) of this article shall have effect so as to restrict the driving of vehicles on any right of way across the Western section of the railway path for the purpose of going to or from any property. [Article 3 amended by BR 42/1993 effective 24 September 1993]

Horse drawn vehicles one way only

4 No horse drawn vehicle shall be driven along the Western section of the railway path otherwise than in a Southerly direction.
