1 In this Act unless the context otherwise requires, "Minister" means the Minister charged with responsibility for Works and Engineering. Minister may sell land reclaimed from sea

(1) Subject to this section, the Minister, on behalf of the Government of Bermuda, may, with the approval of the Cabinet but without further sanction of the Legislature, sell and convey absolutely to any person at a fair market price approved by the Cabinet any lot of land being property of the Government of Bermuda and forming part of any lands reclaimed from the foreshores of Bermuda or from the bed of the sea adjacent thereto.

(2) With respect to the sale and conveyance of any such lot of land as aforesaid the following provisions shall have effect—

(a) the Minister shall not sell and convey the lot of land to any person other than a neighbouring landowner likely to be affected unless he has previously offered to sell and convey the lot of land at the same or a lower price to

each of such neighbouring landowners and the offer has been refused by each of them;

(b) the order in which the Minister shall offer to sell and convey the lot of land to neighbouring landowners likely to be affected shall be such as may be determined by the Cabinet.

(3) In this section the expression "neighbouring land owner likely to be affected" means a person having a freehold estate in land (either contiguous to or in the near vicinity of the lot of land intended to be sold or conveyed) being land the use and enjoyment of which would, in the opinion of the Cabinet be likely to be protected, safeguarded or enhanced if the person having the freehold estate therein were to acquire the lot of land intended to be sold and conveyed.

(4) A conveyance of land on the sale thereof under this Act may be in the form set out in the Schedule, or as near thereto as circumstances permit, or in such form as the Attorney-General advises.

Powers under this Act additional to any other powers

3 The foregoing provisions of this Act shall be in addition to and not in derogation of those provisions of any other Act whereby powers are conferred upon the Minister with respect to the sale and conveyance of land the property of the Government of Bermuda.

Conveyance of Land under the Sale of Reclaimed Lands Act, 1951 I (name) Minister charged with responsibility for Works and Engineering, of Bermuda, in accordance with the Sale of Reclaimed Lands Act, 1951, and in consideration of the sum of (purchase price) this day paid by (name of purchaser in full) of (place of residence) into the Consolidated Fund, do hereby grant and release unto the said (name of purchaser) ALL THAT (description of land to be conveyed) together with all rights and appurtenances thereto belonging TO HOLD the same unto and to use of the said (name of purchaser) . In witness whereof, etc.
