SPORTS, CAMPING AND RECREATIONAL AREAS ACT 1977

Interpretation
1 In this Act— “declared area” has the meaning assigned thereto by section 2; “the Department” means the Department of Sport and Recreation; “the Minister” means the Minister responsible for sport; “regulations” means the regulations made under section 7. 2. Minister may make order designating declared area
(1) The Minister may by order made under this section and published in the Gazette declare any area of land—
(a) owned or leased by the Government; and

(b) set aside for sport or camping or for any other recreational purpose, to be a declared area for the purposes of this Act.
(2) Any order made under this section declaring a declared area shall describe the boundaries of that area.
Minister may authorize persons to use facilities
3 The Minister may enter into an agreement with any person authorizing him and any group, association or organization he represents to use and enjoy the facilities of any declared area subject to such terms and conditions as the Minister may determine.
Control of facilities
4 The Department shall be responsible for the care, management and operation of the facilities of the declared areas and any authorized officer of the Department may—
(a) enter upon any such area at any time for the purpose of ensuring the proper use of the facilities;
(b) exclude trespassers and persons acting in a disorderly manner or in breach of the regulations;
(c) require any person whom he reasonably believes to be committing or to have committed an offence to give him his name and address.
Notices
5 The Minister may on land comprising a declared area cause notices to be erected indicating—
(a) that the area is a declared area;
(b) the boundaries of the area;
(c) whether public access to that area is permitted; and
(d) the restriction imposed by the regulations on the use thereof.
Offences
6 Any person who within a declared area—
(a) wilfully takes, removes or destroys any plant, tree or shrub, or makes any excavation or removes any sand, stone or soil; or
(b) defaces or damages any of the amenities, fixtures or facilities thereof; or
(c) deposits or causes to be deposited any refuse, cans, litter or other material except in receptacles or at places designated by the Minister; or
(d) fails to comply with any order or direction of an authorized officer of the Department; or

(e) fails to give his name and address on being lawfully required to do so under section 4(c); or
(f) contravenes any provision of the regulations, commits an offence: Punishment on summary conviction: a fine of $200 or, in the case of a continuing offence, a fine $50 for each day for which the offence continues.
7. Minister may make regulations
(1) The Minister may make regulations governing the use of the declared areas and for the protection and preservation of the facilities and amenities thereof, and, without prejudice to the generality of the foregoing, regulations may—
(a) provide for the care, preservation, control and management of the areas;
(b) control the use or keeping of horses, dogs and other animals;
(c) control the use, setting out and extinguishment of fires;
(d) control the erection, posting or display of notices, signs and advertisements;
(e) control the use of vehicles or boats in or near the areas;
(f) control or license trades, businesses, sports, entertainments and other activities or undertakings; and
(g) prescribe fees for the use of facilities.
(2) Regulations under this section may make different provision for different areas.
(3) Regulations made under this section shall forthwith be published in the Gazette and shall be subject to negative resolution procedure.
