1. Preparation and custody of Survey Book; evidence

(1) The Commissioners appointed under the Survey of Bermuda (Parish Boundaries) Act 1899 [title 19 item 34], shall in addition to complying with the requirements of section 8 of that Act, prepare a Survey Book containing full and minute particulars of the respective parish boundaries as found and determined by the Commission under that Act, and the Survey Book shall be certified by the Commissioners under their hands and seals as containing an accurate description of the true and correct parish boundaries of Bermuda as found and determined by the Commission.

(2) The Survey Book prepared and certified as aforesaid shall be filed and kept in the Department of Works and Engineering.

(3) Copies of, or extracts from, the Survey Book certified by the Chief Surveyor for the Department of Works and Engineering (hereinafter referred to as "the Chief Surveyor") under his hand and official seal (to be provided at the public expense) to be true and correct copies of, or extracts from, the Survey Book shall (subject to section 6 of the Survey of Bermuda (Parish Boundaries) Act 1899 [title 19 item 34]) be receivable in evidence in all courts in Bermuda in all matters and questions relating to

or in any wise affecting any parish boundary described in the Survey Book.

Custody of certified extracts from Survey Book by Parish Councils

2 As soon as conveniently may be after the Survey Book referred to in section 1 has been filed in the Department of Works and Engineering, the Chief Surveyor shall cause to be prepared at the public expense and furnished to each Parish Council in Bermuda a certified extract from the Survey Book containing the description of the true and correct boundaries of such parish as found and determined by the Commission under the Survey of Bermuda (Parish Boundaries) Act 1899 [title 19 item 34], and such certified extracts respectively shall be kept in the official custody of the respective parish council clerks in like manner as other parish records and documents.

Fee payable to Chief Surveyor for certifying copy

3 Whenever the Chief Surveyor is called upon to certify under his hand and seal any tracing, copy or reproduction of the map required to be filed in the Department of Works and Engineering under section 7 of the Survey of Bermuda (Parish Boundaries) Act 1899 [title 19 item 34], or any copy of or extract from the Survey Book required to be filed therein under section 1, he shall, except when the certification is done by him for some public purpose in his official capacity as Chief Surveyor, be entitled to receive therefor, from the person requiring such certificate, a fee of one dollar and twenty cents.

5 For the purposes of this Act and of any other Act authorizing the use of an official seal by the Chief Surveyor, that officer shall be furnished with an official seal with such device as the Governor may approve.
