Interpretation

1 In this Act— "the principal Act" means the Pensions and Gratuities (War Service) Act 1947 [title 9 item 39]; "war pension" means a pension awarded under section 11 under section 13 or under section 15 of the principal Act; "war pensioner" means a person who has been awarded and is being paid a pension under the principal Act; "temporary bonus," in relation to a war pensioner, means temporary bonus or allowance payable under this Act.

Temporary bonus

2 Subject to the succeeding provisions of this Act, there shall be payable to every war pensioner in addition to his war pension temporary bonus of an amount set out in the Table contained in the Schedule.

Sections 21 and 22 of principal Act to apply

3 The provisions of section 21 and of section 22 of the principal Act (which provisions relate to the payment of war pensions) shall have effect with respect to the payment of, or other dealing with, any temporary bonus as those provisions have effect with respect to the payment of, or other dealing with, war pensions.

Suspension of payment

4 Any temporary bonus otherwise payable to a war pensioner—

(a) shall not be paid in respect of any period during which the war pensioner is not paid a war pension; and

(b) shall, in any case where the war pension paid to the war pensioner is reduced under section 23, under section 24 or under section 27 of the principal Act, be reduced proportionately;

(c) shall, in any case where the war pension otherwise payable to the war pensioner is paid to any other person, or is otherwise administered, under section 25, under section 26 or under section 27 of the principal Act, be deemed for the purposes of those sections to be part of the war pension otherwise payable under the principal Act to the war pensioner and may be dealt with accordingly.

Commencement

5 This Act shall be deemed to have had effect as from 1 April 1950.

Section 15 of the principal Act: Equivalent to one fifth of the amount of the war pension paid under section 15 of the principal Act together with the amount (if any) of any pension awarded under any United Kingdom Statute, or under the law of any Dominion or under any Royal Warrant and taken into account by virtue of that section in calculating the amount of war pension falling to be paid thereunder.
