WATER RESOURCES (WELL DIGGERS) REGULATIONS 1976

[made under section 39 of the Water Resources Act 1975 [title 20 item 14] and brought into operation on 6 March 1976]

Interpretation

1 In these Regulations unless the context otherwise requires— "the Act" means the Water Resources Act 1975 [title 20 item 14]; "Form" means form prescribed in the Schedule; "sample bag" means sample bag provided under regulation 7.

2. Form of licence

(1) A well digger's licence shall be in Form 1.

(2) A well digger's licence shall not be valid unless it is signed by both the Chairman of the Authority and the licensee.

3. Fossil red soil; sample to be taken

(1) Where in the course of constructing a well a well digger finds any deposit of fossil red soil he shall take a sample of debris from the excavation containing fragments of such deposit.

(2) A sample taken under paragraph (1) shall where practicable be placed in a sample bag and shall be of a weight of not less than 250 grams.

(3) The well digger taking a sample under this regulation shall attach thereto a label showing—

(a) the location of the well;

(b) the depth from the surface of the deposit from which the sample originates;

(c) the date on which the sample was taken;

(d) the number allotted to the sample by the well digger, being a number which will distinguish such sample from other samples taken in the construction of the same well.

4. Other samples of rock or material

(1) Where In the course of constructing a well a well digger finds any rock or material which, in his opinion, is of an unusual character he shall take a sample of the debris from the excavation containing fragments of such rock or material.

(2) A sample taken under this regulation shall be taken and labelled in the same manner as a sample taken under regulation 3.

5. Water samples

(1) Upon completing the construction of a well for the abstraction of water a well digger shall take a sample of the water therein.

(2) A sample taken under paragraph (1) shall where practicable be placed in a bottle provided by the Environmental Engineer under regulation 7 and shall be of a volume of not less than half a liter.

(3) The well digger taking a sample under this regulation shall attach thereto a label showing the location of the well and the date upon which the sample was taken. [regulation 5 amended by 1998:19 effective 18 June 1998]

6. Returns

(1) Upon completing the construction or extension of a well and any necessary works ancillary thereto the well diggers shall as soon as practicable and in any case not less than seven days thereafter make a

return to the Minister in Form 2 and such return shall be accompanied by the samples taken under these Regulations.

(2) A return under this regulation shall be a return relating to the construction of wells for the purposes of section 24 of the Act and shall be sent to the Minister In care of the Environmental Engineer at the Offices of the Department of the Environment, Hamilton. Supply of sample bottles and bags

7 Bags and bottles for the taking of samples under these Regulations may be obtained free of charge from the Environmental Engineer whose duty it shall be to supply them, but a failure of the Environmental Engineer to supply such bags or bottles shall not be an excuse for not taking a sample.
