QUOFATAFERUNT BERMUDA GOVERNMENT FEES AMENDMENT REGULATIONS 2026 BR 22 / 2026 The Minister of Finance, in exercise of the power conferred by section 2 of the Government Fees Act 1965, makes the following Regulations: Citation

1 These Regulations, which amend the Government Fees Regulations 1976, may be cited as the Government Fees Amendment Regulations 2026. Revokes and replaces Head 1

2 Head 1 of the Schedule to the Government Fees Regulations 1976 is revoked and replaced with the following— “ Head 1 Agriculture Act 1930 NOTE: For the purposes of this Head, “registered farmers” means farmers registered with the Department of Environment and Natural Resources.

(1) Issuing a certificate to export plant material (phytosanitary) under regulation 24 of the Agriculture (Control of Plant Disease and Pest) Regulations 1970 for—

(a) registered farmers Nil

(b) any other person $45

(2) Issuing a certificate to export plant material (phytosanitary) under regulation 24 of the Agriculture (Control of Plant Disease and Pest) Regulations 1970 (same day service) for—

(a) registered farmers Nil 1 GOVERNMENT FEES AMENDMENT REGULATIONS 2026 Head 1 Agriculture Act 1930

(b) any other person $55

(3) Issuing a permit to import plant material into Bermuda—

(a) 1 -10 genera $40

(b) 11 - 20 genera $55

(c) 20+ genera $80

(4) Issuing a permit to import food crop plant material into Bermuda for Nil registered farmers

(5) Issuing a permit to import plant material into Bermuda (same day service) for—

(a) registered farmers Nil

(b) any other person $80

(6) Importation of agricultural/horticultural products including media $420 without permission, thereby requiring the retroactive issuance of a permit

(7) Issuing a permit to import used equipment, vehicles for—

(a) registered farmers Nil

(b) any other person $70

(8) Inspection of used equipment at the dock for—

(a) registered farmers Nil

(b) any other person $105

(9) Inspection of lumber of any material requiring assessment for entry at the dock (per inspection and follow-up) for—

(a) registered farmers Nil

(b) any other person $105

(10) Inspection of regulated items outside of normal working hours for—

(a) registered farmers Nil

(b) any other person $85 per hour or part thereof

(11) Inspection of any material posing risk to plant life/environment including bio-hazardous materials (per inspection) for—

(a) registered farmers Nil

(b) any other person $105

(12) Emergency documentation issuance for quarantine material release for—

(a) registered farmers Nil

(b) any other person $30

(13) Plant inspection: where 1 box equivalent to less than 300 bedding/ $5 low complexity/ nursery plants; or 500 cuttings; or 100 orchids— risk inspection per box 2 GOVERNMENT FEES AMENDMENT REGULATIONS 2026 Head 1 Agriculture Act 1930 $10 medium complexity/risk inspection per box $25 high complexity/risk inspection per box

(14) Inspection of imported food crop plant material for registered Nil farmers

(15) Testing of incoming material (e.g. soil, nematode tests, plant cultures, assays etc.) at time of entry for—

(a) registered farmers (10 free tests per farm per annum and $105 per test thereafter)

(b) any other person $105 per test

(16) Processing of infested shipment - re-inspection fee $15 low complexity/risk inspection per box $35 medium complexity/risk inspection per box $60 high complexity/risk inspection per box

(17) Processing of infested shipment - re-inspection of imported food Nil crop plant material for registered farmers

(18) Disposal fee (disposal of inspected shipments - boxes, items, pallets, shipments, etc.) for—

(a) registered farmers Nil

(b) any other person $25 small unit/low risk per unit $50 medium unit/ medium risk per unit $100 large unit/ high risk per unit

(19) Pesticides for treatment for—

(a) registered farmers Nil

(b) any other person 25% mark-up on the cost of pesticide

(20) Processing application for importation of conventional pesticides and issuing a letter to authorize/deny importation of pesticides under section 47A(1)(b) for— 3 GOVERNMENT FEES AMENDMENT REGULATIONS 2026 Head 1 Agriculture Act 1930

(a) registered farmers Nil

(b) any other person $60 per pesticide

(21) Rush processing of application for importation of conventional pesticides for—

(a) registered farmers Nil

(b) any other person $100

(22) Rush processing of application for importation of environmentally- safe pesticide for—

(a) registered farmers Nil

(b) any other person $35

(23) Issuing a letter to authorize importation of any pesticides under $200 per section 47A(1)(b) - at time of importation pesticide

(24) Processing application for importation of environmentally-safe Nil pesticides and issuing a letter to authorize/deny importation of pesticides under section 47A(1)(b)

(25) Examination of BCD and verification of invoice for permission to import pesticides for—

(a) registered farmers Nil

(b) any other person—

(i) 1 to 5 items $50

(ii) 6 to 10 items $60

(iii) more than 10 items $70

(iv) importation of prohibited pesticide $555 per pesticide

(26) Examination of BCD and verification of invoice for permission to import environmentally-safe pesticides only for—

(a) registered farmers Nil

(b) any other person—

(i) 1 to 5 items $10

(ii) 6 to 10 items $20

(iii) more than 10 items $30

(27) Issuing a certificate attesting to suitability of water supply for horticultural purposes or soil fertility including pH and salts for—

(a) registered farmers Nil

(b) any other person $40

(28) Issuing a nematode certificate (local processing) for—

(a) registered farmers Nil

(b) any other person $55

(29) Issuing a certificate attesting to suitability of water supply for horticultural purposes or soil fertility including pH and salts (same day service) for—

(b) any other person $50

(30) Examination of BCD for potting soil or soil amendments for—

(a) registered farmers Nil

(b) any other person $58

(31) Storage fees $0.90 per pallet per day

(32) Banana ripening $1.50 per box ”. Amends Head 80

3 Head 80 (Water Resources Act 1975) of the Schedule to the Government Fees Regulations 1976 is amended by deleting paragraph (1) and substituting— “ (1) Considering an application for a new water right under section 11 $90 ”. Commencement
