Interpretation

2. Fees

(1) Subject to this section, the fees specified in the Schedule shall be payable to the Deputy Governor in respect of the several matters therein specified, being matters that arise out of the operation of the British Nationality Act 1981.

(2) Of the fee payable in respect of the grant of a certificate of naturalisation under the British Nationality Act 1981, $2.40 shall be payable on the submission of the application for a certificate and shall in no circumstances be returned; and the balance shall be payable on the receipt of the decision to grant a certificate:

Provided that where a husband and wife apply at the same time for certificates of naturalisation and are residing together at the time of the applications and the balance is paid in respect of the grant of a certificate to one of them, no balance shall be payable in respect of the grant of a certificate to the other.

(3) Any fee paid to the Deputy Governor under this section shall be disposed of by him as follows—

(a) if the matter in respect of which the fee is paid is a matter which, under the British Nationality Act 1981 or any regulations made thereunder, falls within the functions to be discharged by the Governor, the fee shall be paid by the Deputy Governor into the Consolidated Fund of Bermuda;

(b) if the matter in respect of which the fee is paid is a matter which, under the British Nationality Act 1981 or any regulations made thereunder, falls within the functions to be discharged by the Secretary of State, the fee shall be paid by the Deputy Governor to or to the credit of Her Majesty's Principal Secretary of State for Home Affairs: Provided that for the purposes of this subsection the grant by the Governor of a certificate of naturalization shall be regarded as a matter which falls within the functions to be discharged by the Governor, acting in his discretion, notwithstanding that arrangements under section 43 (1) of the British Nationality Act 1981 may provide for any such function as is therein mentioned to be exercisable only with the approval of the Secretary of State.

3. Offences

(1) Any person who for the purpose of procuring anything to be done or not to be done under the British Nationality Act 1981 makes any statement which he knows to be false in a material particular, or recklessly makes any statement which is false in a material particular, commits an offence against this Act: Punishment on summary conviction: imprisonment for 3 months.

(2) Any person who fails to comply with any requirements imposed on him by regulations made under the British Nationality Act

1981 with respect to the delivering up of certificates of naturalisation commits an offence against this Act: Punishment on summary conviction: a fine of $1,680.
