BUILDING AUTHORITY (FIRE PRECAUTIONS) REGULATIONS 1962

[made under section 101 of the Board of Trade Act 1930 [repealed], brought into operation on 21 November
1932 under the title “The Board of Trade (Fire Precautions) Regulations 1932 (which was altered to the present title by 1962:1) and in force by virtue of the Board of Trade Act 1930 [repealed] and the Building Authority Act 1962 Schedule]
Power to inspect buildings
1 Any member of the Building Authority or any of its officers or a Fire Inspector appointed under section 28(1) of the Fire Safety Act 2014 may enter any building or premises outside the limits of the City of Hamilton and of the Town of St. George, between the hours of 9 a.m. and 6 p.m. for the purpose of ascertaining whether such building or premises contains any rubbish or trash of a combustible nature which may constitute a danger of fire. [Regulation 1 amended by 2014 : 33 s. 55 effective 1 January 2018]
Removal of combustible rubbish
2 Should any such materials be found in any such building or premises as aforesaid, the Building Authority, in consultation with the Chief Fire Officer, may give notice in writing to the owner or to the occupier of the building or premises, or to both the owner and the occupier, requiring the removal therefrom of such rubbish or trash, within a time specified in such notice. [Regulation 2 amended by 2014 : 33 s. 55 effective 1 January 2018]
Fire precautions in hotels
3 It shall not be lawful for any building outside a municipal area of more than two storeys in height above the ground level to be used as an hotel boarding-house or lodging- house unless such building is provided with adequate fire extinguishers and outside fire- escape approved by the Building Control Officer and the Chief Fire Officer:

Provided that in the case of buildings of fireproof construction, the Building Authority and the Chief Fire Officer may approve of other systems of fire-escapes in accordance with the provisions of the Fire Safety Act 2014. [Regulation 3 amended by 2014 : 33 s. 55 effective 1 January 2018]

4 These Regulations shall only apply to buildings or premises to which the public have access.
