COLONIAL PRISON SERVICE MEDAL REGULATIONS 1978

[made by His Excellency the Governor under the authority of Royal Warrants dated 28th October, 1955 and 15th September, 1977]

Interpretation

1 In these Regulations, unless the context otherwise requires— "Department" means the Department of Corrections established under the Prisons Act 1979 [title 10 item 32]; "Medal" means the Colonial Prison Service Medal. [Regulation 1 amended by 2002:17 s.4 effective 14 December 2002]

2. Service required

(1) The Medal shall be granted as a reward for long service and good conduct to staff of all ranks in the Department who on or after the

28th October, 1955 have completed eighteen years continuous service is hereinafter defined.

(2) A Clasp may be granted to a recipient of the Medal on his completing twenty-five years qualifying service, and a further Clasp on his completing thirty-five years qualifying service.

(3) For each Clasp awarded under paragraph (2) a small rose shall be added to the ribbon when worn alone.

Continuity of service

3 Qualifying service in the Prison Service of other Colonies or Territories under Her Majesty's Protection or Administration may be allowed to reckon towards the required period of qualifying service, if the total period of such service amounts to not less than eighteen years: Provided however, that where service has been rendered in more than one such territory as aforesaid an interval not exceeding twelve months between any two periods of service shall not be regarded as breaking the continuity of such service; and provided also that a break in service not exceeding six calendar months in any one such territory shall not be regarded as breaking the continuity of such service.

Qualifying service

4 For the purpose of these Regulations service shall be reckoned as qualifying only if it is certified by the Commissioner of Prisons that the person recommended for the grant of the Medal has had no disciplinary charges brought against him during the whole of the period of qualifying service.

Police service

5 Previous service in the Bermuda Police Service may also be allowed to reckon towards the required period of qualifying service, if such service is continuous with service in the Department. [regulation 5 amended by 1997 : 37 effective by notice in Official Gazette]

6. Recommendation by Commissioner of Prisons

(1) Recommendations for the award of the Medal or Clasp shall be submitted to the Governor by the Commissioner of Prisons.

(2) The Medal will be awarded on the authority of the Governor, and a notification of such award shall be published in the Gazette.

7. Forfeiture

(1) A recipient of the Medal or Clasp who is convicted of a criminal offence or is dismissed from the Department for misconduct shall forfeit the Medal and Clasp unless the Governor shall otherwise direct.

(2) A notice of forfeiture shall in every case be published in the Gazette.
