CONTRIBUTORY PENSIONS (VOLUNTARY PAYMENTS) REGULATIONS 1968

[made under section 31 of the Contributory Pensions Act 1967 [repealed] and brought into operation on 17 August 1968]

Citation

1 These Regulations may be cited as the Contributory Pensions (Voluntary Payments) Regulations, 1968.

2. Voluntary payments to make up deficiencies

(1) Subject to paragraph (2) an insured person may make up deficiencies in his record arising from the following circumstances—

(a) for any period during which he is receiving full-time education or is attending a course of training approved by the Director;

(b) if he is normally gainfully occupied in Bermuda and normally relies on being gainfully occupied for his livelihood, for contribution week each day of which is, for him, a day of incapacity for work or a day of unemployment;

(c) if he is normally gainfully occupied in Bermuda and normally relies on being gainfully occupied for his

livelihood, for any contribution week each day of which is, for him, a day of leave (other than leave arising from incapacity to work) without pay: Provided that not more than 26 contribution weeks shall be taken into account under paragraph (b) of this regulation for every period of interruption of employment: Provided also that not more than eight contribution weeks shall be taken into account under paragraph (c) of this regulation for every period of leave without pay.

(2) No deficiency in relation to any contribution week may be made up under this regulation at a date later than three months after the end of the contribution year in which that contribution week falls. [Paragraph 2 amended by 2002:27 s.3(1) effective 6 December 2002]

Evidence

3 For the purposes of these Regulations, it shall be evidence of incapacity for work or unemployment or absence on leave without pay (other than leave arising from incapacity to work) if the insured person furnishes to the Director a certificate by a registered medical practitioner, the Manager of the Government Employment Office or his employer, as the case may be. [Paragraph 3 amended by 2002:27 s.3(1) effective 6 December 2002]

Meaning of "temporary absence"

4 For the purposes of section 13(2) of the Contributory Pensions Act 1970 [title 18 item 7], a "temporary absence" shall mean a period or periods of absence from Bermuda not exceeding three months in any contribution year.
