CUSTOMS DUTY (BELCO NORTH POWER STATION) REMISSION ORDER 2019

The Minister of Finance, in exercise of the power conferred by section 2 of the Customs Duty (Special Remission) Act 1951, makes the following order:
Citation
1 This Notice may be cited as the Customs Duty (BELCO North Power Station) Remission Order 2019.
Interpretation
2 In this Notice— “BELCO” means the Bermuda Electric Light Company; “exempted goods” means fittings, fixtures or other goods used to construct, equip, finish or furnish the construction of the undertaking, except construction equipment, tools, clothing, headgear and footwear; “undertaking” means the BELCO North Power Station at the BELCO power station facility in Pembroke.
Exempted person
3 BELCO is an exempted person for the purposes of this Order and for the purposes of the Customs Duty (Special Remission) Act 1951.
Exemption from import duty
4 BELCO is granted complete exemption from the payment of import duty that would otherwise be payable under the Customs Tariff Act 1970 on the exempted goods imported by them or their agents, provided that such goods are to be used only to construct, equip, furnish or finish the undertaking.

5. Commencement
(1) This Order is deemed to have come into operation on 1 September 2018 and expires on 31 August 2020.
(2) At the expiration of this Order, goods that have been imported with the benefit of duty remission shall not be subject to any further import duty by reason only that this Order has ceased to have effect.
