CUSTOMS DUTY (BERMUDA BROADCASTING COMPANY LIMITED)

BR 56 / 2017

The Minister of Finance, in exercise of the power conferred by section 2 of the Customs Duty (Special Remission) Act 1951, makes the following Order:

Citation

1 This Order may be cited as the Customs Duty (Bermuda Broadcasting Company Limited) Remission Order 2017.

Interpretation

2 In this Order— “customer premises equipment” shall have the meaning given in section 2 of the Electronic Communications Act 2011; “exempted goods” means electronic communications equipment, apparatus and machinery, except customer premises equipment; “undertaking” with respect to Bermuda Broadcasting Company Limited means—

(a) to repair damage due to a lightning strike to the electronic communications equipment, apparatus and machinery owned by the Bermuda Broadcasting Company ;

(b) to modernize the business generally; for the purposes of providing free of charge television and radio broadcasting services in Bermuda.

CUSTOMS DUTY (BERMUDA BROADCASTING COMPANY LIMITED)

Exempted person

3 Bermuda Broadcasting Company Limited is an exempted person for the purposes of this Order and for the purposes of the Customs Duty (Special Remission) Act 1951.

Exemption from import duty

4 Bermuda Broadcasting Company Limited is granted a complete exemption from the payment of import duty charged on the exempted goods that would otherwise be payable under section 2 of the Customs Tariff Act 1970, provided that such goods are intended to be used or imported in connection with the undertaking.

5. Commencement and expiration

(1) This Order is deemed to have come into operation on 1 October 2016 and expires on 1 October 2021.

(2) At the expiration of this Order, goods that have been imported with the benefit of duty remission shall not be subject to any further import duty by reason only that this Order has ceased to have effect.
