DRIVING INSTRUCTORS (LICENSING) REGULATIONS 1965

[made under sections 77, 102 and 103 of the Motor Car Act 1951 [title 212 item 4] and brought into operation on 13 April 1965]

Interpretation

1 In these Regulations, unless the context otherwise requires— "the Examining Committee" means the body of persons appointed by the Minister under regulation 4; "licence" means a licence issued by the Minister under Regulation 3.

2. Application for licence

(1) Any person wishing to act as a driving instructor for hire or reward shall apply to the Minister for a licence.

(2) The application for a licence shall be in such form as the Minister may from time to time determine.

(3) Every application for a licence shall be accompanied by two photographs of the applicant, such photographs to be two inches square, and by the prescribed fee to cover the cost of the examination of the applicant.

3. Conditions for issue of licence

(1) The Minister shall not issue a licence to an applicant therefor unless—

(a) he is twenty-three years of age or over;

(b) he satisfies the Minister that—

(i) he is a person of good character and temperate habits;

(ii) he has a good record as a driver of motor-cars;

(iii) he has held a valid driver's licence for a period of two years immediately preceding the date of his application; and

(iv) during the said period of two years, he has not been convicted of any offence under sections 34,

35 and 36 of the Road Traffic Act 1947 [title 21 item 3].

(c) he satisfies the Examining Committee that he is competent to give instruction in the driving of motor- cars;

(d) in the case of a person who does not possess Bermudian status under the Bermuda Immigration and Protection Act 1956 [title 5 item 16], he produces to the Minister a certificate signed by the Chief Immigration Officer stating that the applicant has been permitted to engage in gainful employment in Bermuda.

(2) Upon being satisfied in respect of all the requirements contained in paragraph (1), the Minister shall, subject to the provisions of Regulation 7, issue to the applicant therefor a licence to act as a driving instructor.

4. Examination of applicant

(1) The Minister shall from time to time appoint a committee consisting of not less than two persons, to be called the Examining Committee, for the purpose of examining applicants for a licence.

(2) The Minister shall make available free of charge to every applicant for a licence a printed copy of the syllabus upon which the examination is based.

(3) The examination of applicants for a licence shall be held at such times and at such places as the Minister may, by notice in the Gazette, appoint.

(4) Upon the conclusion of the examination of an applicant for a licence, the Examining Committee shall submit a report to the Minister stating whether or not the applicant has satisfied the Examining Committee that he is competent to give instruction in the driving of motor-cars.

5. Expiration of licence

(1) A licence issued by the Minister shall be valid until the thirty-first day of December of the year in respect of which it is issued.

(2) During the month of December of every year, the Minister shall, on the application of the licence-holder and subject to the payment by him of the prescribed fee, renew the licence for a period of one year.

6. Revocation of licence

(1) If at any time it is made to appear to the Minister that the holder of the licence is no longer a fit and proper person to hold a licence, the Minister shall address to the licence-holder a notice in writing informing him that his licence will be revoked unless within a period of fifteen days he satisfies the Minister that his licence should not be revoked.

(2) The notice mentioned in paragraph (1) shall specify the grounds upon which the Minister will rely for the revocation of the licence.

(3) As from the date of the receipt by the licence-holder of the notice mentioned in paragraph (1), the validity of his licence shall be deemed to have been suspended until such time as the question of the revocation or otherwise of the licence has been determined.

(4) If the licence-holder fails to satisfy the Minister that his licence should not be revoked as provided in this regulation, the Minister shall revoke his licence.

(5) For the purpose of this regulation, the Minister may at any time require a licence-holder to be medically examined by a registered medical practitioner approved by the Minister or to be re-examined by the Examining Committee in respect of his competence to give instruction in the driving of motor-cars.
