ELECTRICITY (LICENCE THRESHOLD) REGULATIONS 2018

The Minister responsible for energy, in exercise of the powers conferred by section 5 of the Regulatory Authority Act 2011 and section 54 of the Electricity Act 2016, makes the following Regulations:
Citation
1 These Regulations may be cited as the Electricity (Licence Threshold) Regulations
2018.
Interpretation
2 In these Regulations— “the Act” means the Electricity Act 2016; “electricity sector” has the meaning given in section 2(1) of the Act; “generation” has the meaning given in section 2(1) of the Act.
Application
3 These Regulations apply to the electricity sector.
Licence threshold
4 For the purposes of the definition of “licence threshold” in section 2(1) of the Act, the installed capacity from which a licence is required for generation is 500 kilowatts (0.5 megawatts). [Regulation 4 amended by BR 43 / 2021 reg. 2 effective 5 April 2021 to reduce 500 kilowatts to 250 kilowatts for the period from 5 April 2021 ending on 31 May 2021]
