ELECTRICITY (REGULATORY AUTHORITY FEES) REGULATIONS 2021

The Minister responsible for energy, for the purpose of establishing Regulatory Authority fees for the electricity sector pursuant to the Electricity Act 2016, in exercise of the power conferred by section 44 of the Regulatory Authority Act 2011, makes the following Regulations:

Citation

1 These Regulations may be cited as the Electricity (Regulatory Authority Fees) Regulations 2021.

2. Schedule of fees payable

(1) In respect of the items specified in the Schedules, there shall be paid the Regulatory Authority fee specified in relation to each such item.

(2) The fees payable under paragraph (1) shall be payable to the Regulatory Authority.

Dedicated charge

3 The Electricity Transmission, Distribution and Retail Service Provider may recover from the end-user the fees payable under paragraph (1) of Schedule 1 by a dedicated charge on the end-user.

Validation of application fees

3A The Regulatory Authority (Application Process for Electricity Licences) General Determination 2017 is hereby validated in respect to the requirement of the payment of the application fees set out in Schedule 2. [Regulation 3A inserted by BR 31 / 2023 reg. 2 effective 1 April 2023]

Revocations

4 The following regulations are revoked—

(a) Electricity (Regulatory Authority Fees) Regulations 2018; and

(b) Regulatory Authority (Service Fees) Regulations 2018.

Commencement

5 These Regulations come into operation on 1 April 2021.

GENERAL REGULATORY FEES PAYABLE

Type of Electricity Provider Fee

(1) Electricity Transmission, Distribution and Retail $0.00545 per kilowatt- Service Provider hour sold (payable quarterly in arrears)

(2) Utility Scale Electricity Generation provider (greater $1,000 per megawatt per than 25 megawatts of installed electricity generation annum of installed capacity) electricity generation capacity (payable quarterly)

(3) Fossil Fuel Bulk Electricity Generation provider (greater $1,500 per megawatt per than 0.5 megawatts but less than 25 megawatts of annum of installed installed electricity generation capacity) electricity generation capacity (payable quarterly)

(4) Waste-to-Energy Bulk Electricity Generation provider $1,500 per megawatt per (greater than 0.5 megawatts but less than 25 annum of installed megawatts of installed electricity generation capacity) electricity generation capacity (payable quarterly)

(5) Renewable Energy Bulk Electricity Generation provider $1,500 per megawatt per (greater than 0.5 megawatts but less than 25 annum of installed megawatts of installed electricity generation capacity) electricity generation capacity (payable quarterly)

(6) Large Scale Self-Supply Licence provider (greater than $6,500 per megawatt per

0.5 megawatts of installed electricity generation annum of installed capacity) electricity generation capacity (payable quarterly)

(7) Innovative Licence provider $6,500 per megawatt per annum of installed electricity generation capacity (payable quarterly)
