ELECTRONIC COMMUNICATIONS (REGULATORY AUTHORITY FEES) REGULATIONS 2022

The Minister responsible for telecommunications, in exercise of the power conferred by sections 6 and 11 of the Electronic Communications Act 2011, as read with section 44 of the Regulatory Authority Act 2011, makes the following Regulations:
Citation
1 These Regulations may be cited as the Electronic Communications (Regulatory Authority Fees) Regulations 2022.
2. Schedule of fees payable
(1) In respect of the items specified in the Schedules, there shall be paid the Regulatory Authority fee specified in relation to each such item.
(2) The fee payable under paragraph (1) shall be payable to the Regulatory Authority.
Revocation
3 The Electronic Communications (Regulatory Authority Fees) Regulations 2021 are revoked.
Commencement
4 These Regulations shall come into operation on 1 April 2022.

SCHEDULE 1
(regulation 2) GENERAL REGULATORY FEES PAYABLE
Type of authorization holder Fee
(1) Holder of an integrated communications operating licence 1.65% of licensee’s (“ICOL”), in respect of each twelve-month period. relevant turnover (Fee to be paid by quarterly instalments in arrears. Payments shall be estimated in each quarter and shall be subject to adjustment as necessary within six months of the end of the relevant financial year.)
(2) Holder of a Submarine Cable Communications Operating 1% of licensee’s gross Licence (“SubCOL”), in respect of each twelve-month period. revenue from providing Applies only to those submarine cables providing electronic electronic communications to the Bermuda market. communications to the (Fee to be paid by quarterly instalments in arrears.
