EMPLOYMENT (PROBATIONARY PERIOD EXEMPTION) REGULATIONS 2021

The Minister responsible for labour relations, in exercise of the power conferred by sections 19(6)(e) and 45 of the Employment Act 2000, makes the following Regulations:
Citation
1 These Regulations may be cited as the Employment (Probationary Period Exemption) Regulations 2021.
Interpretation
2 In these Regulations— “educators” includes—
(a) Bermuda College faculty;
(b) principals, deputy principals and school teachers;
(c) preschool administrators;
(d) school programme directors and school career pathway coordinators;
(e) school counsellors and school social workers;
(f) educational therapists, educational therapist assistants and para- professionals;
(g) school librarians and school library assistants;
(h) school attendance officers; and
(i) such other education posts under which duties are required to be carried out over a period of at least a school year;
EMPLOYMENT (PROBATIONARY PERIOD EXEMPTION) REGULATIONS 2021
“school” has the meaning given in section 2 of the Education Act 1996.
Employees exempted from six-month and three-month probationary period
3 Pursuant to section 19(6)(e) of the Employment Act 2000 (“the Act”), the six-month and three-month probationary periods referred to, respectively, in section 19(1) and (3) of the Act shall not apply to educators.
