FIREARMS (GENERAL) REGULATIONS 1974
[made under section 33 of the Firearms Act 1973 [title 10 item 5] and brought into operation on 11 May 1974]

SCHEDULE
Interpretation
1 In these Regulations unless the context otherwise requires:— "the Act" means the Firearms Act 1973 [title 10 item 5]; "Commissioner" includes any police officer acting on behalf of the Commissioner;

"Form" means a form prescribed in the Schedule.
2. Forms
(1) The forms set out in the Schedule shall be used for the purposes of the Act and these Regulations with such variations as the circumstances of the case may require.
(2) The following are the forms set out in the Schedule —
(a) Form F 1, being the form of an annual or temporary firearm licence;
(b) Form F 2, being the form of an annual or temporary ammunition licence;
(c) Form F 3, being the form of a gun licence;
(d) Form F 4, being the form of a firearm dealer's licence;
(e) Form F 5, being the form of a rifle club licence;
(f) Form F 6, being the form of a removal permit;
(g) Form F 7, being the form of application for a firearm licence (both annual and temporary), a gun licence and an ammunition licence;
(h) Form F 8, being the form of application for an ammunition licence by an officer or servant of a licensed rifle club;
(i) Form F 9, being the form of application for a rifle club licence;
(j) Form F 10, being the form of application for a firearm dealer's licence;
(k) Form F 11, being the form of application for a removal permit;
(l) Form F 12, being the form of a permit to remove granted to the holder of a firearm or ammunition licence.
3. Licence requirements
(1) No licence issued under the Act shall be of any effect unless it is signed both —
(a) by the Commissioner; and
(b) by the holder thereof, except in the case of a rifle club licence, or a firearm dealer's licence issued to a body corporate, in which case the holder's signature shall be dispensed with.

(2) No licence authorising a firearm or ammunition to be kept at any premises shall be granted unless such premises have been inspected by the Commissioner.
(3) Applications for a licence shall be made at the Police Headquarters.
(4) No licence shall be issued or renewed until the appropriate fee therefor prescribed under the Government Fees Act 1965 [title 15 item 18] has first been paid.
(5) A licence may be renewed or varied by an endorsement thereon to that effect stating the period of the renewal or, as the case may be, the nature of the variation and signed by the Commissioner.
(6) In this regulation "licence" includes a removal permit and a permit to remove.
Change of address
4 A firearm licence, ammunition licence and gun licence shall be granted or renewed subject to the condition (whether or not in addition to any other conditions) that the holder must, without undue delay, inform the Commissioner of any change in his permanent address.
5. Application for licence
(1) An application for a firearm licence shall be accompanied by two passport size photographs of the applicant.
(2) Where application is made for an annual firearm licence the information contained in Part IV of Form F 7 shall be certified to be correct by an officer of the rifle club to which the applicant belongs.
(3) No temporary firearm licence shall be granted to a member of a rifle club outside Bermuda who requires such licence to take part in a sporting event organised by a licensed rifle club unless—
(a) the licensed rifle club has first notified the Commissioner of the date and place of the sporting event and of the name of the overseas rifle club participating; and
(b) the application is accompanied by the applicant's club identification or other evidence to the satisfaction of the Commissioner that the applicant is a member of a rifle club outside Bermuda.
(4) A firearm licence shall be issued subject to the condition (whether or not in addition to any other conditions) that no firearm to which it relates shall be exported from Bermuda except under the authority conferred by a permit to remove in Form F 12 and subject to compliance with regulation 12.

5A. Verification
(1) The information given by the applicant in answer to questions 1, 2, 4 and 5 of Part I of Form F 7 shall be verified by the signed statement of a person who satisfies the requirements of paragraph (2) that the information is, to the best of his knowledge and belief, correct.
(2) To satisfy the requirements of this regulation a person must not be a member of the applicant's family, and must be -
(a) except where application is made for a temporary firearm licence by a member of a rifle club outside Bermuda, a Commonwealth citizen; and
(b) a member of Parliament, justice of the peace, minister of religion, doctor, lawyer, bank officer or person of similar standing, and have known the applicant for at least two years. [note: this regulation has been renumbered "5A" to eliminate duplication]
6. Ammunition licences
(1) No application for an ammunition licence by an officer or servant of a licensed rifle club for ammunition required for the purposes of the club shall be entertained unless evidence to the satisfaction of the Commissioner is produced to show that such person has the authority of the club to make such application.
(2) An ammunition licence issued to an officer or servant of a licensed rifle club may be issued subject to the condition (whether or not in addition to any other conditions) that the ammunition shall be stored in bulk by the Commissioner.
(3) Where ammunition is stored by the Commissioner in accordance with a condition imposed under paragraph (2) —
(a) the ammunition licence shall authorise the holder thereof to have in his possession such ammunition as may be issued to him by the Commissioner from store;
(b) the Commissioner may refuse to issue ammunition in the interests of public safety or in excess of the amount which, in his opinion, constitutes the reasonable requirements of the club;
(c) Section 34(2) of the Act applies to such ammunition while so stored.
(4) An ammunition licence shall be issued subject to the condition (whether or not in addition to any other conditions) that no ammunition to which it relates shall be exported from Bermuda except

under the authority conferred by a permit to remove in Form F 12 and subject to compliance with regulation 12.
(5) An ammunition licence may be issued subject to the condition (whether or not in addition to any other conditions) that the ammunition to which it relates shall not be imported or purchased otherwise than through or from the holder of a firearm dealer's licence.
(6) An ammunition licence in Form F 2 may be combined with a firearm licence in Form F 1 in such manner as the Commissioner may direct.
Delivery of ammunition; endorsement of licence
7 Where a firearm dealer delivers ammunition to any person authorised to possess such ammunition under an ammunition or gun licence he shall at the time of delivery cause to be endorsed upon such licence the quantity of and type of ammunition delivered and the date of delivery and he, or the person making delivery, shall initial such endorsement. _
8. Firearm dealer's licences
(1) Where the person making application for a firearm dealer's licence is a body corporate such application shall be made on behalf of such body corporate by the director, manager, secretary or other similar officer thereof.
(2) A firearm dealer's licence shall be granted or renewed subject to the following conditions (whether or not in addition to any other conditions) —
(a) that the quantity of ammunition to be stored by the dealer shall not exceed the quantity stated in the licence;
(b) no firearm or ammunition shall be exhibited either in the window or elsewhere on the dealer's premises;
(c) any person desiring to purchase a firearm or ammunition shall identify himself to the satisfaction of the person in charge thereof before the firearm or ammunition is shown to him;
(d) firearms and ammunition shall not be produced to a customer at the same time;
(e) that where ammunition is sold to any person such person's ammunition licence shall be endorsed in accordance with these Regulations;
(f) that the dealer shall not advertise publicly or by notice displayed at his premises that he is a firearm dealer or

that he has for sale or can procure any firearm or ammunition.
Application for registration of rifle club
9 An application for a rifle club licence in Form F 9 shall be accompanied by the following —
(a) the constitution of the club;
(b) the names and addresses of the officers of the club and the date upon which they were appointed or elected:
(c) the names and addresses of all members of the club and the dates upon which they first became members.
10. Hand grenades for extinguishing fires
(1) Nothing in the Act or these Regulations shall apply to the importation, possession or use by the Bermuda Fire and Rescue Service of bombs or hand grenades manufactured for the purpose of extinguishing fires but subject thereto and to the provisions of this regulation such bombs or hand grenades shall be deemed to be ammunition for the purposes of the Act.
(2) Subject to paragraph (1) such a bomb or hand grenade shall not be possessed, purchased, acquired or imported save under the authority of a licence and in accordance with the terms thereof.
(3) A licence issued under this regulation shall be deemed to be a licence for the purposes of the Act and shall be, as nearly as may be practicable, in the form of an ammunition licence.
(4) A licence issued under this regulation shall be granted for such period as the Commissioner may determine. [Regulation 10(1) amended by 2007:23 s.17 effective 2 July 2007]
Club identification
11 Every licensed rifle club shall issue annually to each of its member in good standing a club identification and such document shall state the period in respect of which it is valid.
12. Permit to remove firearm or ammunition from Bermuda
(1) A person removing any firearm or ammunition from Bermuda under the authority of a removal permit or a permit to remove shall at the time of removal obtain from a customs officer, or from an officer of the air line or the shipping agent effecting removal a certificate witnessing to such removal.
(2) A certificate for the purposes of paragraph (1) shall be endorsed on the removal permit or permit to remove, as the case may be.

(3) As soon as practicable after the removal of a firearm or ammunition from Bermuda under a removal permit or a permit to remove the holder thereof shall return such permit, endorsed as aforesaid, to the Commissioner.
