FISHERIES (PROTECTED AREAS) ORDER 2000

BR 38 / 2000

The Minister responsible for fisheries, in exercise of the power conferred on him by section 4 of the Fisheries Act 1972 makes the following Order:—

Citation

1 This Order may be cited as the Fisheries (Protected Areas) Order 2000.

Protected areas

2 The following areas are declared to be protected areas for the purposes of section

4 of the Fisheries Act 1972:

“Cristobal Colon” located 32o 29.1'N, 64o 42.5'W - the area within 300 metres 1 radius of a mooring buoy at the wreck of the “Cristobal Colon”; “North East Breaker” located 32o 29.0'N, 64o 42.5'W - the area within 300 metres 2 radius of the North East Breaker beacon; “Taunton” located 32o 29.5'N, 64o 41.5'W - the area within 300 metres radius of a 3 mooring buoy at the wreck of the “Taunton”; “Aristo” located 32o 28.5'N, 64o 39.4'W - the area within a 300 metres radius of a 4 mooring buoy at the wreck of the “Aristo”; “Mills Breaker” located 32o 24.6'N, 64o 37.8'W - the area within 300 metres radius 5 of Mills Breaker beacon; “Pelinaion” & “Rita Zovetto" located 32o 21.3'N, 64o 38.4'W - the area within 500

6 metres radius of a mooring buoy at the wrecks of the vessels “Pelinaion” and “Rita Zovetto”; “The Cathedral” located 32o 19.6'N, 64o 39.4'W - the area within 300 metres 7 radius of the mooring buoy at the site known as the Cathedral;

“Kate” located 32o 19.4'N, 64o 41.7'W - the area within 300 metres radius of a 8 mooring buoy at the wreck of the vessel “Kate”; “Tarpon Hole” located 32o 16.2'N, 64o 46.6'W - the area within 300 metres radius 9 of a mooring buoy at the site known as Tarpon Hole; “Hermes” & “Minnie Breslauer” located 32o 14.4'N, 64o 47.4'W - the area within

10 500 metres radius of the mooring buoy at the wrecks of the vessels “Hermes” and “Minnie Breslauer”; “Marie Celeste” located 32o 14.5'N, 64o 49.9'W - the area within 300 metres radius 11 of a mooring buoy at the wreck of the “Marie Celeste”; “South West Breaker Area” located 32o 13.8'N, 64o 51.8'W - the area within 600 12 metres radius of a mooring buoy at South West Breaker; “North Carolina” located 32o 15.6'N, 64o 57.5'W - the area within 300 metres 13 radius of a mooring buoy at the wreck of the “North Carolina”; “Airplane” located 32o 15.2'N, 64o 58.6'W - the area within 300 metres radius of a 14 mooring buoy at the wreck of the airplane; “Blanche King” located 32o 16.3'N, 64o 58.5'W - the area within 300 metres radius 15 of a mooring buoy at the wreck of the “Blanche King”; “Darlington” located 32o 17.2'N, 64o 59.0'W - the area within 300 metres radius of 16 a mooring buoy at the wreck of the “Darlington”; “L’Herminie” located 32o 19.1'N, 64o 58.5'W - the area within 300 metres radius of 17 a mooring buoy at the wreck of the “L’Herminie”; “Vixen” located 300 metres west of Daniel’s Head, Sandys - the area within a 100 18 metres radius of the wreck “Vixen”; “Commissioner’s Point Area” being the area within a 200 metres radius of a stake

19 located at 32o 19.72N, 64o 49.93W and bounded on the south-west and south- east by the shore; “Lartington” located 32o 21.8'N, 64o 54.8'W - the area within 300 metres radius of 20 a mooring buoy at the wreck of the “Lartington”; “Constellation Area” located 32o 21.8'N, 64o 54.8'W - the area within 500 metres 21 radius of a mooring buoy at the wreck of the “Constellation”; “Montana” located 32o 21.7'N, 64o 54.8'W - the area within 300 metres radius of 22 a mooring buoy at the wreck of the “Montana”; “Eastern Blue Cut” located 32o 23.4'N, 64o 53.1'W - the area within 600 metres 23 radius of a mooring buoy at Eastern Blue Cut; “Xing Da Area” located 32o 25.0'N, 64o 54.4'W - the area within a 200 metres 24 radius of a mooring at the wreck of the “Xing Da”; “Snake Pit” located 32o 26.5'N, 64o 50.3'W - the area within 300 metres radius of 25 a mooring buoy at the area called Snake Pit; “Hog Breaker” located 32o 27.5'N, 64o 49.8'W - the area within 300 metres radius 26 of a mooring buoy at Hog Breaker; “Caraquet” located 32o 27.7'N, 64o 50.1'W - the area within a 300 metres radius of 27 a mooring buoy at the wreck of the “Caraquet”;

“Madiana” located at 32o 27.5'N, 64o 48.5'W - the area within 300 metres radius 28 of a mooring buoy at the wreck of the “Madiana”; “North Rock” located at 32o 28.5'N 64o 46.1'W - the area within 1,000 metre 29 radius of the North Rock beacon. “Niobe Corinthian” located at 32o 27.5244'N, 64o 47.1345'W - the area within 200 30 metres radius of a mooring buoy at the wreck of the Niobe Corinthian. 3. Prohibited activities

(1) The following activities are prohibited within a protected area:

(a) the taking of fish;

(b) the use within a protected area of any anchor other than a Danforth

(sand) anchor.

(2) Without prejudice to subparagraph (1), the taking of fish is prohibited during the period beginning on 15 April and ending on 14 August in any year in any of the following areas:

(a) “South Western Area” being roughly rectangular in shape, is the area enclosed: from the Northern Point (32 degrees 16.4 minutes North, 65 degrees 3.2 minutes West) by a line running in a south-easterly direction to the Eastern Point (32 degrees 16.1 minutes North, 65 degrees 0 minutes West) thence by a line running in a south-easterly direction to the Southern Point (32 degrees 11.9 minutes North, 64 degrees 57.1 minutes West) thence by a line running in a south-westerly direction to the Western Point (32 degrees 11.0 minutes North, 65 degrees 0 minutes West): and on the Seaward margin by the 200 metre contour.

(b) [deleted] and

(c) “North Eastern Area” being roughly rectangular in shape, is the area enclosed: from the Northern Point (32 degrees 31.7 minutes North, 64 degrees 39.3 minutes West) by a line running in a south-westerly direction to the Western Point (32 degrees 30.8 minutes North, 64 degrees 40.4 minutes West) thence by a line running in a south-easterly direction to the Southern Point (32 degrees 25.8 minutes North, 64 degrees 34.1 minutes West) thence by a line running in a north-easterly direction to the Eastern Point (32 degrees 26.2 minutes North, 64 degrees 33.0 minutes West): and on the Seaward margin by the 200 metre contour.

(3) Without prejudice to subparagraph (1), the taking of fish is prohibited during the period beginning on 15 April and ending on 30 November in any year in any of the following areas—

(a) “South Western Grouper Box” being square in shape, is the area enclosed: from the Northern Point (32 degrees 15.73 minutes North, 65

degrees 2.64 minutes West) by a line running in a easterly direction to the Eastern Point (32 degrees 15.73 minutes North, 65 degrees 1.74 minutes West) thence by a line running in a southerly direction to the Southern Point (32 degrees 14.88 minutes North, 65 degrees 1.74 minutes West) thence by a line running in a westerly direction to the Western Point (32 degrees 14.88 minutes North, 65 degrees 2.64 minutes West) thence by a line running in a northerly direction back to the Northern Point.

(b) “North Eastern Grouper Box” being square in shape, is the area enclosed: from the Northern Point (32 degrees 28.60 minutes North, 64 degrees 35.60 minutes West) by a line running in a easterly direction to the Eastern Point (32 degrees 28.60 minutes North, 64 degrees 34.70 minutes West) thence by a line running in a southerly direction to the Southern Point (32 degrees 27.75 minutes North, 64 degrees 34.70 minutes West) thence by a line running in a westerly direction to the Western Point (32 degrees 27.75 minutes North, 64 degrees 35.60 minutes West) thence by a line running in a northerly direction back to the Northern Point.

(4) Without prejudice to subparagraph (1) and notwithstanding—

(a) subparagraph (2), the taking of fish is prohibited in the areas set forth in subparagraph (2) during the period beginning on 22 April 2023 and ending on 14 August 2023;

(b) subparagraph (3), the taking of fish is prohibited in the areas set forth in subparagraph (3) during the period beginning on 22 April 2023 and ending on 30 November 2023. Revocation of BR 17/1990

4 The Fisheries (Protected Areas) Order 1990 is revoked.

Commencement

5 This Order comes into force on 1st May 2000. .
