The Development
The Minister of the Environment in exercise of the powers conferred upon her by section 15(1) of the Development and Planning Act 1974, makes the following Order:
Citation
1 This Order may be cited as the Manufactured Homes Housing Project (Sandys Parish) Special Development Order 2005.
MANUFACTURED HOMES HOUSING PROJECT (SANDYS PARISH) SPECIAL DEVELOPMENT ORDER 2005
Interpretation
2 In this Order, unless the context otherwise requires — “development” means the development referred to in the planning applications and more particularly described in the
First Schedule — ;
“planning applications” means the applications for planning permission for the development made by the Ministry of Works and Engineering and Housing, dated 7 November 2005 and numbered P1102/05 and P1103/05, and the accompanying Topographical Drawings numbered 3933/005/01 and 4030/001/01 prepared by that Ministry; “sites” means the sites described in the Second Schedule.
3. Planning permission
(1) Subject to the conditions specified in subparagraph (2), planning permission is granted by this Order for the development of the sites.
(2) The conditions referred to in subparagraph (1) are as follows –
(a) no construction work shall commence until the required building permit is issued under the Building Act 1988;
(b) all access roads and junctions with public roads shall be sited, designed and laid out in accordance with the requirements of the Ministry of Works and Engineering and Housing and in compliance with section 8 of the Bermuda Plan 1992 Planning Statement;
(c) the mode, design and specification of the proposed methods of sewage disposal and the supply of water within the sites shall comply with any directions given by the Chief Environmental Health Officer in respect of public health; and
(d) where practicable, utility cables shall be placed underground within the curtilage of the sites.

FIRST SCHEDULE
1. The Development
housing units distributed between the sites as follows: Site 1 (Beacon Hill Road, Sandys Parish) 2 units Site 2 (Constitution Road, Morgan’s Point, Sandys Parish) 8 units
2. Each housing unit to have a 3,000 gallon buried water storage
3. tank.
4. The construction of, or improvements to, access roads and
junctions with public roads.
SECOND SCHEDULE
The Sites Site 1 ALL THAT LAND in Sandys Parish at Beacon Hill Road, having an approximate area of 0.34 acres as shown on the Ministry of Works and Engineering and Housing Topographical Drawing number 3933/005/01 (attached). Site 2 ALL THAT LAND in Sandys Parish at Constitution Road, Morgan’s Point, having an approximate area of 0.48 acres as shown on the Ministry of Works and Engineering and Housing Topographical Drawing number 4030/001/01 (attached).
