ARRANGEMENT OF SECTIONS

WHEREAS it is expedient to make provisions in respect of licence fees payable in relation to duty free sales and duty free warehouses at the Bermuda Airport and to validate certain airport duty free licence fees which were charged and collected by the Minister: Be it enacted by The Queen's Most Excellent Majesty, by and with the advice and consent of the Senate and the House of Assembly of Bermuda, and by the authority of the same, as follows:⎯

Short title

1 This Act may be cited as the Government Fees Airport Duty Free Licence Fees and Validation Act 2000.

Interpretation

2 In this Act, unless the context otherwise requires—

GOVERNMENT FEES AIRPORT DUTY FREE LICENCE FEES

"Act" means the Bermuda Airport (Duty Free Sales) Act 1997; "Bermuda Airport" has the meaning assigned to that expression by section 1 of the Civil Airports Act 1949; "licence fees" means fees payable—

(a) under section 4 of the Act in respect of the operation of a regulated shop at the Bermuda Airport; and

(b) under section 34 of the Act in respect of the operation of a duty free warehouse at the Bermuda Airport; "Minister" means the Minister of Finance; "regulated shop" has the meaning assigned to that expression by section 2 of the Act.

3. Licence fees, etc.

(1) The fee payable in respect of the grant of—

(a) an Airport Duty Free Sales Licence under section 4 of the Act is $1,000;

(b) an Airport Duty Free Warehouse Licence under section

34 of the Act is—

(i) $5,000, where the value of the bond for

scheduled goods is $100,000 or less;

(ii) $10,000, where the value of the bond for

scheduled goods exceeds $100,000.

(2) The Minister may, by Regulations made under section 2(1) of the Government Fees Act 1965, vary the amount of the licence fees specified in subsection (1); and, on the coming into operation of such Regulations, subsection (1) shall cease to have effect.

Validation of licence fees

4 Where, prior to the coming into operation of this Act, the Minister had charged and collected any licence fees, such licence fees shall, on the coming into operation of this Act, be deemed to have been validly charged and collected and no action, suit or proceeding shall be brought against the Minister by reason only of such charge or of such collection.
