GOVERNMENT FEES REGULATIONS 1976
SR&O 24 / 1976
[made under section 2 of the Government Fees Act 1965 and brought into operation on 1 March 1976]
Interpretation
1 In these Regulations—
(a) “function” has the meaning assigned to it in the Government Fees Act
1965 [title 15 item 18];
(b) any reference to a provision of law under which a function is performed shall include a reference to any statutory instrument having effect under that provision of law;
(c) any reference to a section without mention of an Act is a reference to the section of the Act under which the relevant function is performed;
(d) any reference to a search of any record-books maintained by a public officer is a reference to a search bona fide conducted for one document only, or as respects a search in any register or index, otherwise than for tracing any particular document, is a reference to a search bona fide conducted for one entry only.
2. Schedule of fees payable
(1) In respect of each of the functions specified in a Head in the Schedule (being functions performed under the provision of law set out immediately following the number of that Head) there shall be paid a fee as set out in that Head in relation to such function.
(2) Any fee payable under paragraph (1) shall be payable to the public authority performing the function, unless the payment of the fee is regulated by paragraph (3).

(3) Where the Accountant General by notice published in the Gazette directs that a fee shall be payable to him, the fee shall be payable to the Accountant General in accordance with the notice and not any longer to the public authority performing the function.

(a) whereby a charge is levied where there are elapses between the expiry date of a permit and the date of receipt of an application to renew the permit
(b) Applying—
(i) to transfer a person with a valid work permit to another $435 company within the same group of companies or on merger or takeover, where his duties remain the same
(ii) to promote such a person on a work permit from his $435 current job to another, in the same business
(iii) to change the job title of such a person whose employer $435 and duties remain the same
(iv) to change the name of the company where there has not $435 been a merger or takeover and the business remains
(6) Applying under section 60 for permission to employ a person without Bermudian status who is one of the following, that is to say, the parent or lawful guardian of, and has legal custody of, a person with Bermudian status who is under 18 years of age—
(a) under a work permit valid for such period as may be specified $116 in the permit
(b) under a letter of permission (where the Minister may grant $120 such permission for a period of time specified in the letter not exceeding 1 year to not-for-profit organisations, including registered charitable organisations, for the employment of coaches, teachers of sports and recreation, clergy, speakers and musicians)

(c) under a letter of permission (where the Minister may grant $116 such permission for a period of time specified in the letter not exceeding 1 year) to not-for-profit organisations, where the services being provided are free of charge at the request and for the direct benefit of the Government
(7) Applying for a work permit refund in respect of categories (vi) to (xii) $17 of paragraph (5)(a)—
(a) the person concerned never arrived in Bermuda; or
(b) satisfactory evidence is provided to the Department that indicated the person concerned never commenced employment with the employer identified in the work permit; The work permit fee will be refunded less an administration fee of $165.
(8) A refund will be granted in respect of categories (vi) to (xii) of paragraph (5)(a) where—
(a) a particular term of work permit is applied for and the Department grants a term less than that applied for, the difference in fees between the two work permit terms will be refunded less an administration fee of $165 (e.g. if a three (3) year standard work permit is applied for and a two (2) year standard work permit is granted, the Department will refund the differential of one (1) year less the administration fee).
(b) a particular term of work permit is applied for and the Department refuses to grant the work permit applied for, the work permit fee will be refunded less an administration fee of $165.
(c) a work permit is cancelled prior to a decision being made, the work permit fee will be refunded less an administration fee of $165.
(d) a work permit application has been submitted incomplete and a new work permit application was submitted in accordance with the work permit policy service level, the work permit fee application will be returned to the employer less an administration fee of $165 with a checklist identifying incorrect or missing documents.
(8A) Considering—
(a) an application by a restricted person, or a trustee for the $1,706 benefit of a restricted person, for a licence to hold or acquire land

(b) “accessory structures” includes, but is not limited to, tennis courts, parking areas, driveways, docks, walls, satellite dish receivers, signs, piers, platforms, patios and like structures which do not result in the creation of additional, enclosed floor space, that are incidental to the principal building and located on the same lot; and, for the avoidance of doubt, a swimming pool is not an accessory structure and any separate application for a pool shall be subject to the minimum fee set out in either subparagraph (a)(i)(A) or (b)(i)(A), whichever is applicable;
(c) “re-inspection of works” means a re-inspection made because, at a previous scheduled visit to the works, either—
(i) conditions at the works prevented proper access to the works;
(ii) the works did not meet the requirements of the Bermuda Building Code Regulations 2014;
(iii) the works for some other reason were not available or ready for inspection;
(iv) a copy of the approved drawings was not available on-site.
(d) In the case of an existing building where the application relates to building works designed specifically to provide access for, or otherwise meet the needs of, the physically handicapped, no fee shall be charged.
(e) In the case of alterations or extensions to a building listed as a building of special architectural or historical interest in accordance with section 30 of the Development and Planning Act 1974, no fee shall be charged.
