GOVERNMENT HOUSING AREAS (TOP SQUARE, ST. GEORGE) SERVICE CHARGES AND REFUSE COLLECTION REGULATIONS 1975

[made under section 7 of the Housing Areas Act 1971 [title 29 item 4] and brought into operation on 22 February 1975]

Housing areas to which the Regulations apply

1 These Regulations shall apply within the housing area defined in the Government Housing Area (Top Square, St. George) Declaration Order 1974 [title 29 item 4(c)].

2. Service charge

(1) There shall be levied on all premises held on 99 year leases and used for residential purposes within the housing areas to which these Regulations apply a service charge in the amount of $40 a month, which amount shall be due and payable on the first day of each and every month, or if that day is a Saturday, Sunday or public holiday, the first business day thereafter.

(2) The service charge shall be payable whether or not it has been formally demanded, at the offices of the Department of Works and Engineering.

3. Additional rate for water

(1) There shall be levied in addition to the charge provided for under regulation 2 on all such premises a further charge at the rate of nought decimal point six cents a gallon for water supplied through a meter to any premises in excess of nine hundred gallons a month.

(2) The charge mentioned in paragraph (1) shall be payable quarterly on demand at the offices of the Department of Works and Engineering.

Power to cut off water supply

4 If the charge provided for under regulation 3 Is not paid within seven days after demand the Minister may cut off the supply of water to the premises and may refuse to restore the supply until all moneys owing in respect of the said charge are paid together with an additional amount of ten dollars to meet the expenses of cutting off and restoring the supply of water.

Liability to pay charges

5 The person liable to pay any charges due under regulations 2 and 3 shall be the householder, and if there is any doubt as to who the householder may be, the Minister's determination in the matter shall be final. The charge shall be payable whether or not the premises are occupied.

6. Disposal of refuse

(1) No person shall keep or place household refuse out of doors except in a bin of durable material having a lid which can be secured in such a manner that it will remain in place If the bin is overturned : Provided that for the purpose of refuse collection household refuse may be placed in a heavy gauge polythene sack properly secured at the neck.

(2) No household refuse shall be placed in any thoroughfare or elsewhere outside the premises on which the refuse originated except for the purpose of refuse collection on days when such collection may reasonably be anticipated.

(3) Any person who contravenes this regulation commits an offence: Punishment on summary conviction; a fine of $100.
