Emoluments of His Excellency the Governor

1 There shall be paid to His Excellency the Governor out of the Consolidated Fund such annual salary and entertainment allowance as shall be included in the annual estimates of expenditure approved by the Legislature.

Emoluments of His Excellency the Governor during absence on leave

2 Where His Excellency the Governor is absent on leave, His Excellency shall be entitled to receive his salary and his entertainment allowance while he is absent on leave, so, however, that His Excellency shall not be entitled to receive his salary and allowance as aforesaid during any periods of absence on leave which exceed in the aggregate eight weeks in any period of twelve months: Provided that —

(a) where His Excellency has not been absent on leave throughout any period of twelve months he shall be

entitled to receive his salary and allowance as aforesaid during any periods of absence on leave which do not exceed in the aggregate sixteen weeks during the period of twelve months next succeeding such period as aforesaid; or

(b) where His Excellency has been absent on leave for periods amounting in the aggregate to less than eight weeks during any period of twelve months he shall be entitled to receive his salary and allowance as aforesaid during any periods of absence on leave which, together with such periods of absence on leave as aforesaid, do not exceed in the aggregate sixteen weeks during the period of twelve months next succeeding such period as aforesaid.

Emoluments of Acting Governor during absence of Governor

3 During any period when His Excellency the Governor is absent on leave or on duty the Acting Governor, if he is an officer in the service of the Government of Bermuda, shall be paid —

(a) a salary equivalent to the salary payable to him in respect of his substantive office together with one-half of the difference between that salary and the salary of the Governor under this Act; and

(b) an entertainment allowance at the rate of one quarter of the entertainment allowance for the time being payable to the Governor under this Act.

Emoluments of Governor's Deputy

4 During any period when His Excellency the Governor is absent from Bermuda or is suffering from an illness which renders him incapable of performing the functions of his office, the Governor's Deputy shall be entitled to receive out of the Consolidated Fund such allowances as he would have received under the provisions of section 3 if he had been the Acting Governor of Bermuda.

Emoluments of Acting Governor during vacancy in office of Governor

5 In the event of the office of Governor being vacant, the Acting Governor shall be entitled to receive out of the Consolidated Fund of Bermuda the following emoluments—

(a) if he is not performing the duties of any other office in the Government of Bermuda, then the total emoluments of His Excellency the Governor;

(b) if he is performing —

(i) the duties of some other office in the Government of Bermuda; or

(ii) any military duties, then the amount specified in section 3.

Public Service Superannuation Act 1981 not to apply

6 The salaries payable under this Act shall not be subject to any deduction under the provisions of the Public Service Superannuation Act
