1 This Order may be cited as the International Organizations (Immunities and Privileges) I.M.F. Order 1983.

Declaration of International Monetary Fund

2 The International Monetary Fund ("the Fund") is declared to be an organization of which Her Majesty's Government in the United Kingdom and the government or governments of one or more foreign sovereign Powers are members.

Immunities of the Fund

3 The Fund shall have the legal capacities of a body corporate, and the immunities and privileges specified in the First Schedule.

Immunities of Dr. Kurt Senff

4 Dr. Kurt Senff, as a person employed in Bermuda on a mission on behalf of the Fund, shall have the immunities and privileges specified in the Second Schedule.

FIRST SCHEDULE (Paragraph 3)

Immunities and Privileges of the International Monetary Fund

1 The Fund shall have the legal capacities of a body corporate and, except in so far as it has waived its immunity in any particular case, immunity from suit and legal process. No waiver of immunity shall be deemed to extend to any measure of execution.

2 The Fund shall have the like inviolability of official archives and premises occupied as offices as is accorded in the United Kingdom in respect of official archives and premises of an envoy of a foreign sovereign Power accredited to Her Majesty.

3 The Fund shall have the like exemption from taxes and rates, other than taxes on the importation of goods, as is accorded in the United Kingdom to a foreign sovereign Power.

4 The Fund shall have exemption from taxes on the importation of goods directly imported by the Fund for its official use in Bermuda or for exportation, or on the importation of any publications of the Fund directly imported by the Fund, subject to compliance with such conditions as the Governor acting on the advice of the Minister of Finance may prescribe for the protection of the revenue.

5 The Fund shall have exemption from all prohibitions and restrictions on importation or exportation in the case of goods directly imported or exported by the Fund for its official use and in the case of any publications of the Fund directly imported or exported by the Fund.

SECOND SCHEDULE

(Paragraph 4)

Immunities and Privileges of Dr. Kurt Senff

1 Except in so far as any immunity or privilege is waived by the Fund, Dr. Kurt Senff shall enjoy while engaged in the Mission the following immunities and privileges, that is to say—

(a) the like immunity from suit and legal process as is accorded in the United Kingdom to an envoy of a foreign sovereign Power accredited to Her Majesty;

(b) the like inviolability of residence as is accorded in the United Kingdom to such an envoy;

(c) the like exemption or relief from taxes as is accorded in the United Kingdom to such an envoy.

2 The Mission mentioned in paragraph 1 above is the Mission of acting as Adviser on behalf of the Fund to the Bermuda Monetary Authority, acting as agent of the Government of Bermuda, on the Compilation of the Balance of Payments of Bermuda.
