1974 : 51 BERMUDA ELECTRIC LIGHT COMPANY POWER STATION GT6-9 GAS TURBINE REPLACEMENT (PEMBROKE PARISH)
The Minister of the Environment and Sports, in exercise of the powers conferred upon him by section 15(2)(a) of the Development and Planning Act 1974, makes the following Order:
Citation
1 This Order may be cited as he Bermuda Electric Light Company Power Station GT6-9 Gas Turbine Replacement (Pembroke Parish) Special Development Order 2009. Interpretation
2.
(1) In this Order— “the Act” means the Development and Planning Act 1974; “the applicant” means the Bermuda Electric Light Company Limited; “Building Official” has the meaning given in the Building Act 1988; “the Development” means the Development described in the First
Schedule — ;
“the planning application” means the application for planning permission for the Development made by the applicant numbered P0250/09 and dated 5th May 2009 and recognized

as a revision to phase 2 of the original applicant number P0794/07 and dated 6th November 2007, and the accompanying drawings numbered GT182-C01A, GT182-C01, GT182-C02, GT182-C03, S-201, S-202, S-401, S-402, GT182-B37-01, GT182-B37-02, and the Environmental Impact Statement (volumes 1 & 2) prepared by Mott MacDonald Pettit Limited and submitted on behalf of the applicant; “the site” means the land described in the Second Schedule;
(2) Subject to subparagraph (1), any expression used in this Order that is also used in the Act has the meaning assigned to it in the Act.
3. Planning permission
(1) For reasons of national importance; and to maintain a reliable and safe supply of electrical power; and to satisfy in an efficient, timely and environmentally responsible way Bermuda’s demand for electrical power, planning permission is hereby granted by this Order for the development of the site, subject to the conditions referred to in subparagraph (2).
(2) The conditions referred to in subparagraph (1) are as follows—
(a) an application for a building permit for the development shall be submitted to and approved by the Building Official prior to the commencement of any construction work;
(b) an application for a building permit shall comply with the requirements of the Building Code 1998 and with the directions given by the Chief Fire Officer in respect of fire protection and the Chief Environmental Health Officer in respect of public health;
(c) an application for a construction permit for any proposed controlled plant shall be approved by the Environmental Authority in accordance with the relevant provisions of the Clean Air Act 1991 prior to the commencement of construction; and
(d) the applicant shall undertake to develop the works described in the application as the installation of a maximum of four gas turbine units in the West Power Station, insofar as these units operate on light fuel oil with a lower sulphur content and to the extent that this is the minimum generating capability required by the

applicant to respond by 2011 to peak loads and to emergency conditions.
Saving
4 For the avoidance of doubt, it is hereby declared that nothing in this Order grants planning permission for any matters of development for which planning permission is required, apart from any matter for which planning permission has been granted by paragraph 3.
FIRST SCHEDULE (paragraph 2(1)) The Development
1 The replacement of existing gas turbine gensets, GT3A-D, located at the West Power Station site. The development provides for the decommissioning of aging, less reliable and lower efficiency generating plant and installation of up to four new gas turbine gensets, GT6-9.
2 Construction of the associated physical plant including GT6-9 Transformer Enclosure, GT6-9 Switchgear Building and renovation of existing storage shed B-37 for use as a gas turbine workshop and tool storage facility.
SECOND SCHEDULE (paragraph 2(1)) The Site ALL THAT LAND in the Parish of Pembroke having an area of 26.17 acres (10.59 hectares) shown outlined in blue on drawing number GT182- C01A accompanying the planning application.
