BERMUDA STATUTORY INSTRUMENT

MARINE & PORTS AUTHORITY (BERTHING & ANCHORING) REGULATIONS 1967
[made under the Marine Board Act 1962 and brought into operation on 9 September 1967]
ARRANGEMENT OF REGULATIONS
1 Anchoring of ship entering port

Anchoring of ship entering port
1 The master or person in charge of any ship entering the ports of Bermuda shall anchor such ship in such position and in such manner as the Harbour Master may direct.
Harbour Master may require ship to be moved
2 The master or person in charge of any ship in the ports of Bermuda which is in the fairway or approach to any dock or channel shall move such ship on being required to do so by the Harbour Master.

Permission to bring ship alongside any dock
3 No person shall, without the permission of the Harbour Master, bring a ship alongside any dock in the ports of Bermuda, or so near thereto as to prevent any other ship from coming alongside or leaving any dock.
Vacation of berth
4 The Harbour Master may require any ship lying alongside any dock to be moved therefrom within such time as he may specify in order to accommodate any other ship which from her size or from any other cause cannot be conveniently accommodated elsewhere and the master or person in charge of a ship to whom any such direction is given shall comply therewith.
Mooring under direction of Harbour Master
5 The master or person in charge of any ship lying at any dock shall moor such ship in such position and in such manner as the Harbour Master may direct.
6. Not to obstruct public landing place with mooring ropes
(1) No person shall cause or permit mooring ropes or hawsers from a ship moored at any dock to be put out across any public landing- place except with the permission of the Harbour Master.
(2) The Harbour Master may require any person who places any mooring rope or hawser in contravention of this regulation, or the employer of such person, to remove such mooring rope or hawser and the person to whom such direction is given shall comply therewith.
Keeping clear when not landing or embarking passengers
7 The master or person in charge of any ship or boat not engaged in landing or embarking passengers at any landing-place in the ports of Bermuda reserved by the Authority as a public landing-place for passengers, shall keep such ship or boat clear of any such landing-place and at such distance therefrom as will permit the free and unrestricted use of the landing-place by any other ship or boat engaged in landing or embarking passengers thereat.
Permission to land freight over 100 lbs
8 No freight or packages of any description, exceeding 100 pounds in weight in all, shall be loaded, unloaded or deposited by any person on any public landing-place for passengers without the express permission of the Authority.

Protection of waters
9 No person shall—
(a) injure, destroy or remove any moorings, float, buoy, stage or other apparatus maintained by the Authority on the docks or shores or in the territorial waters of Bermuda;
(b) deposit or throw any ballast, rubbish or filthy water into the waters of the harbours of Bermuda or so near to the foreshore thereof as to be in danger of being washed or falling into those waters; or
(c) build any wharf, pier, jetty or other structure below high water mark in the waters of the harbours of Bermuda without the previous permission of the Authority.
Offences
10 Any person who contravenes any provisions of these Regulations commits an offence: Punishment on summary conviction: imprisonment for 3 months or a fine of $360 or both such imprisonment and fine.
