MARINE & PORTS AUTHORITY (HAMILTON CHANNELS) REGULATIONS 1967
[made under the Marine Board Act 1962 and brought into operation on 9 September 1967]

Interpretation
1 In these Regulations, unless the context otherwise requires— "Island boat" means every vessel, hulk, steamboat, lighter, motor boat, or other boat, not being a row-boat and not ordinarily employed in voyages to any place beyond the territorial waters of Bermuda;

"master" means the person in charge of any ship or Island boat; "ship" means a sea-going steamer, motor or sailing ship, and includes a hulk or lighter used locally or otherwise; but does not include craft usually plying in inland waters.
Channels to which Regulations apply
2 The Channels to which these Regulations apply are the Head of the Lane Channel, Timlins Narrows and the Two Rock Channel and every approach to and every extension or prolongation of any of them.
Maximum speed of Island boats in Channels
3 No Island boat shall be permitted by the master to pass through the Head of the Lane Channel, Timlins Narrows, or the Two Rock Channel, or any part of any of them, at a rate of speed greater than ten knots.
Two Rock Channel; maximum speed of ships
4 Except in circumstances which render it necessary for the safety of the ship, no ship shall be permitted by the master to pass through the Two Rock Channel, or any part thereof, at a rate of speed greater than ten knots.
5. Two Rock Channel; inward bound ships to give way
(1) No inward bound ship or Island boat shall be permitted by the master to enter the two Rock Channel from the Great Sound while any outward bound ship is in or is approaching or is about to enter that Channel from Hamilton Harbour.
(2) The master of every inward bound ship or Island boat approaching the Two Rock Channel from the Great Sound shall keep such ship or Island boat off and away from the outward entrance to that Channel and at a safe and sufficient distance therefrom while any outward bound ship is in or about to enter or is approaching that Channel from Hamilton Harbour and until such outward bound ship has cleared that Channel.
Signals by ships leaving Hamilton
6 The master of every ship, fitted with a wireless telegraphic apparatus, intending to leave Hamilton Harbour by the Two Rock Channel shall cause to be broadcast by such apparatus, thirty minutes, twenty minutes and ten minutes prior to proceeding to get under way, the International Code Wireless Telegraphy Signal Q T O and the intended time of departure as a warning to incoming ships that his ship is about the proceed through the Two Rock Channel; and, when the ship

is leaving the dock, shall make the same signal Q T O with the word "NOW" to indicate that the ship is then leaving the dock.
Hoisting national flag as signal of claiming priority
7 The master of a ship claiming or intending to exercise the privilege of priority given to such ship by regulation 5 shall, immediately upon weighing anchor in Hamilton Harbour and while in the Two Rock Channel and until his ship has cleared that Channel, hoist and keep hoisted at the main-mast head the national flag of that ship as a signal of his claiming and intending to exercise such privilege of priority.
Two Rock Channel; Island boats to give way
8 The master of every Island boat using or entering or about to use the Two Rock Channel shall at all times give way to any inward or outward bound ship in the use of that Channel.
9. Two Rock Channel; no anchoring unless under stress
(1) Except under stress of weather or circumstances beyond the control of the master, no ship or Island boat shall be permitted by the master to be anchored or moored in the Two Rock Channel or so near thereto as to obstruct, delay or endanger any ship in or about to enter the Channel.
(2) The master of any ship or Island boat who has been forced by stress of weather or other circumstances beyond his control to anchor in or near the Two Rock Channel to avoid accident to his or some other ship or to the Channel, shall not permit such ship or Island boat to remain in that Channel or in any approach thereto for any period longer than is necessary in the circumstances.
Two Rock Channel; ships not to enter in dangerous conditions
10 The master of a ship shall not permit the ship to enter the Two Rock Channel when, on account of the force of the wind, the state of the waters or any other circumstances, such ship cannot use that Channel without danger to herself, or to any other ship, or to the sides of the Channel, or to the buoys, poles or marks in or marking the Channel, or the approaches thereto, or their moorings.
Two Rock Channel; permission for disabled ship to enter
11 No disabled ship shall be permitted by the master to enter or pass through the Two Rock Channel without the previous permission of the Minister or otherwise than in accordance with any conditions attached to such permission by the Minister.

No dumping in any Channel
12 No person shall discharge or deposit any ballast, gravel, rubble, ashes, coke, cinders, coal dust or other solid material, or any fuel oil from any ship or Island boat in the waters of any Channel; and the master of every ship or Island boat shall take all precautions necessary to prevent any such discharge or deposit from such ship or Island boat.
Penalties
13 Any person who contravenes these Regulations commits an offence: Punishment on summary conviction: imprisonment for 3 months or a fine of $360 or both such imprisonment and fine.
