MARINE BOARD (PROHIBITED AREAS) NOTICE 2010

The Minister responsible for marine and ports services, in exercise of the power conferred by section 10(1)(aa) of the Marine Board Act 1962, issues the following Notice:

Citation

1 This Notice may be cited as the Marine Board (Prohibited Areas) Notice 2010.

Prohibited and restricted areas

2 A ship or boat shall not—

(a) approach within 100 metres of the hull of a ship moored or anchored in the area of the Oil Docks, St. George’s;

(b) approach within 50 metres of—

(i) the hull of a ship moored or anchored in the area of waters designated in Schedule 1;

(ii) the hull of a ship to which the International Ship and Port Facility Security Code (ISPS) applies which is moored or anchored in the area of waters designated in Schedule 2; or

(iii) any vessel which has not been cleared for entry by the Customs Department anchored at Powder Hole, St. George’s Harbour;

(c) approach within 20 metres of the dock face of Berths 7 and 8, Hamilton when no ship is berthed alongside;

(d) enter the area of waters bounded by the shore and lying southward of a line extending from the north end of Long Rock to a position 15 metres south of the north end of Clearwater Beach;

(e) enter the area of waters bounded by the shore and lying westward of a line extending from the south end of Long Rock to the Inner Pear Rocks and thence to the south point of Coopers Island; or

(f) enter the area of waters being a portion of East Whale Bay on the south shore of Southampton parish, lying between Fish Hook Island and Dolphin Cove, and enclosed by a floating boom and a submerged fence.

Revocation of Notices

3 The following Notices are revoked—

(a) Marine Board (Prohibited Areas Designation) Notice 1996 (BR36/1996);

(b) Marine Board (Prohibited Area) Notice 1996 (BR51/96); and

(c) Marine Board (Dolphin Habitat) (Prohibited Area) Notice 1997 (BR1/1997).
